고위공직자범죄수사처(공수처)는 권력형 비리를 근절하는데 그 목적이 있다. 하지만 이는 또한 검찰권의 분산을 초래하므로 검찰개혁과도 관련이 있다. 대체로 공수처 설치를 필요로 하는 데는 세 가지 이유가 있다. 첫째, 권력형 비리로 오염된 우리사회를 정화시키기 위한 것이다. 둘째, 통제불능의 검찰을 원래의 제 자리로 돌려놓기 위한 것이다. 즉, 공수처는 검찰을 견제함으로써 사법권의 균형을 유지케 한다. 셋째, 특검이 제 역할을 다하지 못하고 있는 것도 하나의 이유이다. 이러한 사실은 권력형 비리에 대하여 공수처가 유일한 대안임을 말해준다. 현재 국회에 5개의 공수처 설치에 대한 입법안이 발의되어 있다. 그리고 곧 그들 법안들에 대한 논의가 시작될 것이다. 문제는 입법목적에 맞는 적절한 공수처 설치가 중요하다는 사실이다. 그 주요한 몇 몇 것들을 살펴보면 아래와 같다. 첫째, 공수처는 외부로부터의 독립성이 보장되어야 한다. 둘째, 공수처의 수사대상과 규모가 적절하여야 한다. 대략적으로 보면 20명의 공수처검사와 50명의 공수처수사관이 적당해 보인다. 셋째, 공수처는 수사권과 공소권을 가져야 한다. 넷째, 공수처장은 변호사 자격증을 가진 자일 필요가 없다. 처장은 대통령과 같은 외부세력에 의하여 영향을 받지 않는 중립적인 가치관이 요구될 따름이다. 다섯째, 공수처의 권한을 통제하기 위하여 국회에의 보고의무를 지우는 것이 필요하다. 정상적인 사법권의 작동을 위하여 하루빨리 공수처가 설치되어야 한다.
The purpose of the Independent Investigation Agency(IIA) is to eradicate the power-related corruption. But this is also related to prosecution reform because it causes the distribution of the prosecution rights. There are generally three reasons for the installation of a IIA. First, it is to purify our society polluted by the corruption related to power. Second, it is to return the uncontrollable prosecution to its original position. In other words, it maintains a balance of jurisdiction by checking the prosecution. Third, there is a reason why the Special Prosecutor is not functioning properly. This fact suggests that the only alternative to eradicate the corruption related to power is the IIA. Currently, there are five legislative initiatives in the National Assembly. And soon there will be discussion about them. The problem is that proper installation of IIA is important. Some of the major ones are as follows. First, IIA must be ensured independence from the outside. Second, the target and size of the investigation should be appropriate. Approximately 20 Special Prosecutor and 50 Special Investigator are appropriate. Third, IIA must have both the right of investigation and the right to prosecute. That size would be effective. Fourth, there is no reason to limit captains to lawyers. The captain needs neutral sense of values that are not influenced by the outside, such as the president. Fifth, it is necessary to impose a reporting duty on the National Assembly to control its authority. For the normal operation of jurisdictions, IIA should be installed as soon as possible.
