일본에서는 리벤지 포르노범죄가 일찍이 문제가 되어 리벤지 포르노범죄에 대처하기 위해 단행법률로 ‘리벤지 포르노방지법’이 제정되었다. ‘리벤지 포르노방지법’은 리벤지 포르노를 공표하는 경우 처벌하는 규정뿐만 아니라 프로바이더 책임제한 특례, 피해자 지원체계의 정비 및 예방교육, 국제협력 등의 내용을 담고 있다. 우리나라의 몰카범죄나 리벤지 포르노범죄도 매우 심각한 수준이다. 이러한 이유로 정부에서 다양한 대책을 발표하고 있으며, 국회에서도 관련 법률의 개정안들이 많이 발의되고 있다. 그러나 관련 법률의 일부분 개정을 통해서 리벤지 포르노 등 범죄들에 대처하기에는 매우 어려운 상황이다. 현재 리벤지 포르노나 몰래카메라 관련 범죄는 「성폭력처벌법」이나 「정보통신망법」에 근거하여 형사처벌의 대상이 된다. 그러나 저작권법과 달리 리벤지 포르노범죄에 대한 전담조직이나 해당 불법정보의 유통을 막기 위한 별도의 규정을 두고 있지 않다. 따라서 리벤지 포르노범죄뿐만 아니라 몰카범죄에 현실적이고 종합적으로 대처할 수 있도록 일본과 같이 단행법 제정을 고려해 볼만하다. 단행법을 제정한다면 리벤지 포르노도 데이트 폭력범죄의 범주에 들어갈 수 있는 만큼 데이트 폭력범죄과 함께 논의되어야 할 것이며, 또한 단행법 제정이 어렵다면 리벤지 포르노범죄도 성폭력 범죄의 범주에 들어가는 만큼 몰카범죄와 함께 「성폭력처벌법」에 독립된 장을 두어 처벌규정 및 영상물의 삭제, 피해자 지원 등의 내용을 입법화하는 것도 고려할 만하다. 전자데이터는 확산되기 쉽고, 확산되고 난 후에는 이것을 삭제하는 것이 거의 불가능에 가깝기 때문에 사전적 예방이 중요하다. 사전적 예방으로 인터넷이라고 하는 인프라가 가진 위험성을 충분히 주지하는 교육의 중요성이 강조되고 있으며, 더불어 국제적 연대를 통한 대처방안 마련도 필요하다.
Hidden camera and revenge porn crimes are reaching a critical level in Korea. Therefore, the government and the national assembly are announce a variety of policies as current laws in force are not able to fight these kind of crimes. However, some amendments of related laws are not a sufficient solution to cope with the crimes. Currently, distribution of any data created by the purpose of revenge porn and hidden camera is subject to criminal prosecution pursuant to the laws on sexual violence crime and information network system, but there are no organization for handling only for revenge porn crimes and regulation for preventing such illegal information, unlike the copyright law. To be realistic about these revenge porn and hidden camera crimes, it is suggested to establish a special law as Japan did. If there is a barrier to establish a special law, it is also considered to add a separate chapter to legalize punishment regulations, cancelation of related contents and support for victims, et cetera, as revenge porn crime is classified to sexual violence crime. Punishment for revenge porn crimes but not showing lackadaisical attitude toward shooting sexual video and just not allowing it is more important because electronic data is easy to be proliferated and it is impossible to cancel it online. The risk that the internet has should be known to the public. In this context, the prevention education on revenge porn crime should be prioritized as well as measurements should be secured through international solidarity.
