우리 민법 제219조는 “어느 토지와 공로사이에 그 토지의 용도에 필요한 통로가 없는 경우에 그 토지소유자는 주위의 토지를 통행 또는 통로로 하지 아니하면 공로에 출입할 수 없거나 과다한 비용을 요하는 때에는 그 주위의 토지를 통행할 수 있고 필요한 경우에는 통로를 개설할 수 있다”고 규정하여, 어느 토지와 공로사이에 그 토지의 용도에 필요한 통로가 없는 경우에는 그 토지 소유자는 주위의 토지를 통행 또는 통로로 이용할 수 있는 법정통행권을 인정하고 있다. 그런데 이러한 주위토지 통행권은 일정한 성립요건이 충족하면 당연히 발생하는 법정통행권인데도 불구하고 토지의 ‘용도에 필요한 통로’의 해석기준에 따라서 흉물스러운 토지로 방치해야 하거나 사회경제적으로도 막대한 손실을 가져올 수 있는 문제가 발생하고 있다. 그리고 민법 제219조는 주위토지 통행권자에게 통행 또는 통로의 개설을 기본적인 내용으로 하고 있는데, 이와 관련하여 특히 현대사회에서 필수적 요소인 자동차의 통로 폭을 인정할 것인지 그리고 건축관련 법령에서 규정하고 있는 기준범위로 주위토지 통행권을 인정할 것인지가 심각하게 문제가 되고 있다. 따라서 본 연구에서는 이에 대한 해결방안으로 우선 토지의 “용도에 필요한 통로”를 어떻게 인정해야 하는 지를 검토하고, 이어서 주위토지 통행권에 대한 통로 폭의 인정범위에서 특히 중요한 자동차의 통로 폭과 건축법령상의 통로 폭에 대한 문제점에 대하여 연구하여 국토의 효율적인 이용과 양당사자의 기본권을 조화롭게 보호하고자 한다.
The ‘Right of Passing over Surrounding Land’ is a legal right of way that naturally occurs if certain conditions are met. However, according to the interpretation standard of “Required for use in Pathway” it must be neglected on a disastrous land, or it can cause huge socioeconomic losses. And in particular, whether to acknowledgment the pathway width of automobiles that are essential in modern society and whether to recognize the right of Passing over Surrounding Land to the standards prescribed by the relevant law of architectural is becoming a serious problem. Therefore, improvement plan on the efficient approach and semantic interpretation to acknowledgment scope of pathway width, is necessary in order to protect of the rights of the both party and taken all social-economic. Therefore, in this study, it is necessary to acknowledgment that “required for use in pathway” should be interpretation widely when the use of land is not sufficient for purposefulness and objective. And if the surrounded land is land for a building, it is needs to be broad interpretation of the provisions of article 219 of the civil code concerning "places and methods with less damage," I think that it is necessary to approve the width of the passage determined by the Building Law to the surrounding landowners. In addition, since automobiles are popularized as an essential element of life in modern society, it is reasonable to acknowledgment the pathway width where automobiles needs to pass through if the surrounded land is a specific and special situation in which the automobile must be in and out of the car.
