안전한 교육환경의 조성은 교육의 기본적인 전체조건이며, 사회적 보호대상인 학생을 안전사고나 학교폭력 등 범죄, 자살, 자연재해 등 각종 위험으로부터 보호하여 건강한 사회구성원으로서 성장시키는 것은 국가와 사회의 기본적인 의무이다. 우리는 짧은 기간 괄목할 만한 경제성장을 이룩하여 왔으며, 사회의 각 부문에서 눈부신 발전이 계속되고 있다. 부족한 자원과 자본의 한계를 극복하고 이러한 발전을 이룩한 근본적인 배경은 국민들의 노력에 있으며, 그러한 발전을 지속적으로 이어올 수 있었던 것도 높은 교육열을 바탕으로 한 교육의 힘이라고 할 수 있다. 하지만 사회발전에 기여할 능력을 갖춘 인재양성에 초점이 맞추어져 교육의 결과에만 치중한 나머지 교육대상자에 대한 보호나 복지에는 소홀했던 것이 우리의 과거이다. 교육과정에서 발생할지 모를 위험 또는 사고를 예방하고, 그러한 위험 또는 사고가 발생할 경우 그 손해를 사회가 보전하는 제도의 마련은 교육복지 차원에서 매우 중요한 과제이며, 바른 교육의 기틀이 되는 것인 동시에 안전한 교육환경의 조성으로 교육영역을 사회복지의 대상영역으로 자리매김하게 하는 의미를 갖는다. 이런 평가를 기반으로 본 연구에서는 우선 학교에서 발생한 각종 사고 특히 스포츠 사고를 둘러싼 책임의 문제를 논의한다. 다음은 학교에서의 사고에 대한 공제급부제도를 일본사례를 중심으로 살펴본다.

The prevention of risks or accidents that may arise in the course of education, such as those arising from the education of the curriculum, and the occurrence of such a risk or accident, is a crucial task for the education of the educational community, and the creation of a secure educational environment forms the basis of the education of the educational community. Based on this assessment, the study discusses the problem of various accidents, especially those surrounding sports accidents. The following reflects the benefits of the exemption benefit system in schools in Japan.
