현대사회에서 진행되고 있는 제4차 산업혁명은 산업혁명을 넘어서 사회구조를 근본적으로 바꾸고 있다. 이를 통해 초연결사회와 빅데이터 사회, 지능정보사회, 안전사회가 출현하고 있다. 이러한 현대사회의 구조변동으로 인해 정보보호의 필요성 역시 증대하고 있다. 이 글은 이러한 상황에서 정보보호 법정책을 어떻게 펼쳐야 하는지의 문제를 다룬다. 먼저 제4차 산업혁명이 야기하는 사회변화가 무엇인지를 살펴본다(II). 여기에서는 초연결사회와 빅데이터 사회, 지능정보사회와 안전사회가 무엇이고 여기에 어떤 위험이 있는지를 분석한다. 이어서 정보보호 관련법, 특히 정보통신망법과 정보통신기반 보호법, 정보보호산업 진흥법이 무엇을 규율하는지, 여기에는 어떤 문제들이 있는지를 다룬다(III). 특히 정보보호 관련법의 비체계성, 관할경합, 거버넌스 경합, 규제방식의 경합, 새로운 정보통신기술 성과의 미흡한 수용을 중점적으로 다룬다. 이를 토대로 하여 제4차 산업혁명에 대응하기 위해 정보보호 관련법을 어떻게 개선해야 하는지, 달리 말해 정보보호 법정책을 어떻게 추진해야 하는지를 제시한다(IV). 이 글은 다음과 같은 테제를 제시한다. 첫째, 입법정책의 측면에서는 통합정보보호법을 제정할 필요가 있다는 것이다. 둘째, 규제정책의 측면에서는 사후적 정보보호에서 사전적 정보예방으로 규제정책의 방향을 바꾸어야 하고, 기술적ㆍ물리적 규제를 강화할 필요가 있다는 것이다. 셋째, 사전적 정보예방을 실현하기 위해 정보공유를 제도화할 필요가 있다는 점을 역설한다.
The 4th industrial revolution of modern society is changing its structure fundamentally. The new paradigms of modern society results from this changing: hyper-connected society, big data society, intelligent information society and secure society (Sicherheitsgesellschaft). For that reason, the necessity of information security in modern society are more and more increasing. In this context, this article deals with the way and methods of legal policy for information security in order to respond to the 4th industrial revolution successfully. At first, this article deals with the question of what are the changes which the 4th industrial revolution is causing (II). The concept and risks of hyper-connected society, big data society, intelligent information society and secure society are here being analysed. Further more, the regulations and problems of the law of information security, e.g. the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc, the Act on the Protection of Information and Communications Infrastructure and the Act on the Promotion of Information Security Industry are handled (III). Especially, the problems of non-systematic regulations, the governance overlapping and the regulation overlapping of the law of information security are here emphasized. Based upon this working, this article proposes finally the way of legal policy for information security to respond to the 4th industrial revolution (IV). This article argues the necessity of integrated information security act, the preference of information prevention oriented regulation, the enhancement of architectural regulation and the importance of the Information Sharing Analysis Center (ISAC).
