대중교통법 개정(2015.12.29)으로 국토교통부 장관은 교통카드 정산업자 등으로부터 교통카드데이터를 수집할 의무를 지고, 교통카드데이터를 이용하고자 하는 자는 국토교통부장관에게 위 데이터 제공을 요청할 수 있게 되었다. 국토교통부는 이상의 수집과 제공을 위해 통합정보시스템을 구축하고 있으며, 해당 시스템의 운영은 교통안전공단에 위탁될 예정이다. 그런데 개인정보 보호에 관한 우리 법의 중층적 체계를 고려할 때 교통카드데이터 수집·제공의 과정에서 법률 간 충돌이 예상된다. 본 연구는 이상의 상황에서 사후 통합정보시스템이 완성되었을 때 현장에서의 혼란을 방지하기 위해, 위 수집·제공의 과정에 적용될 법률에 대해 연구하였다. 먼저 교통카드데이터의 내용을 확정하기 위해, 교통카드데이터 수집·제공 현황 및 주체를 정리하였다. 그리고 교통카드데이터가 주식회사 한국스마트카드에서 국토교통부·교통안전공단을 거쳐 교통카드데이터를 이용하고자 하는 자로 이어지는 정보 전달의 과정에서, 적용되는 법률이 달라지면 정보주체의 동의 요부가 어떻게 달라지는지 검토하였다. 마지막으로 각 법률의 해석 및 교통카드데이터의 성격을 고려하여 상황별로 적용할 법률을 판단하였다. 이상의 연구 결과를 행정청이 참고할 수 있게, 논의된 바를 교통카드데이터관리지침에 반영할 것을 제시한다. 교통카드데이터에 관한 법학 연구가 이루어지지 않은 작금의 상황에서 본 연구의 문제의식 및 연구결과는, 추후 교통카드데이터에 관해 더 심도 있는 연구가 이루어질 밑거름이 될 것으로 기대한다.
Revised Public Transportation Act obliges the Minister of Land, Infrastructure and Transport to collect the Transportation card data, and allows those who want to use the data to request the data to the Minister. Considering the hierarchical system of law on the protection of personal information, conflicts between the law are expected in the process of collecting and providing the data. Therefore, this study investigated the laws to be applied to the process of the collecting and providing. First, in order to determine the contents of the data, the status and the subject of collecting and providing the data are summarized. Then, I examined how the consent of the information subject change when the applicable laws are changed in the course of the information transfer from the Korea Smart Card Co., Ltd. to the person who wants to use the data. Finally, the laws to be applied for each situation were judged by considering the interpretation of each law and the nature of Transportation card data. I suggest that the result of this study should be reflected in the Guideline for managing Transportation card data so that the administrative office can refer to the above discussions.
