이 논문 「<조선경국전>에 나타난 주례 이념」을 고찰한 글이다. 주지하다시피 삼봉(三峯) 정도전(鄭道傳)은 후세의 평가가 어떻든간에 조선의 건국이념을 제시하고 관료 체제의 정비에 이르기까지 그의 손을 거치지 않은 것이 없을 정도로 조선 왕조 500년의 기틀을 다진 인물임에 틀림없다. 정도전은 <주례>를 사회개혁의 이념 모델로 삼아 태조 3년(1394)에 <조선경국전>을 찬진(撰進)하였다. <조선경국전>은 정도전이 신왕조의 문물제도를 정하는 일환으로 저술한 새로운 법전(法典)의 지침서(指針書)로서, 신왕조의 지배 사상인 유교이념에 바탕을 두고 있다. 그는 <주례>의 육전(六典) 체제를 이상적인 모델로 중앙행정 체제를 육전 체제로 설정하고 치전(治典)⋅예전(禮典)⋅정전(政典)은 <주례>의 명칭을 그대로 따랐으나 교전(敎典)은 부전(賦典)으로, 형전(刑典)은 헌전(憲典)으로, 사전(事典)은 공전(工典)으로 당시 현실에 맞게 시행하고자 하였다. <조선경국전>은 조선왕조의 헌법(憲法)이라 할 수 있는 법전이지만 자세한 조문(條文)은 전하지 않고, 육전(六典)마다 총서(摠序)와 항목별 개요라고 할 수 있는 소서(小序)만 남아 있다. 이는 완비된 법전이 아니라 앞으로 법전이 지향해야할 이념과 가치를 제시한 것으로, <조선경국전>이 우리나라 최초의 법전인 <경제육전>은 물론이고 <경국대전> 편찬에 지침서가 되었던 것은 부인할 수 없다.
This paper is to examine philosophy of Jurye(周禮, national rituals) described on Joseongyeonggukjeon. As it is widely known, Sambong Jeong Do-Jeon (三峯 鄭道傳), regardless of evaluation by posterity, is definitely a figure who established 500 years of Joseon with almost everything handled by his own hands from presenting founding principle of Joseon to organizing the bureaucratic system. In the third year of King Taejo (1394) with Jurye as an ideological model for social innovation, Jeong Do-Jeon wrote Joseongyeonggukjeon and offered it to the king. Joseongyeonggukjeon is a sort of guide for new codes written by Jeong Do-Jeon as a part of defining culture and institutions of the new dynasty, which is based on Confucianism, the ruling idea of the new dynasty. Regarding Yukjeon (六典) system of Jurye as an ideal model, he set the central administration system as Yukjeon system and attempted implementation by adapting to the then reality through renaming Gyojeon (敎典), Hyeongjeon (刑典) and Sajeon (事典) as Bujeon (賦典), Heonjeon (憲典) and Gongjeon (工典) respectively while keeping names of Chijeon (治典), Yejeon (禮典) and Jeongjeon (政典) on Jurye. Joseongyeonggukjeon can be called the code of Joseon Constitution but its detailed provisions have not been passed today and what has only remained is its series (擔序) and outlines of each item (小序) of Yukjeon. It was not a complete code but suggested ideology and values for a future code to pursue and it is undeniable that Joseongyeonggukjeon served as a guide not only for Gyeongjeyukjeon, the very first code of the state, but also for Gyeonggukdaejeon.
