원칙적으로 미국 자치경찰제는 기초 자치단체 중심으로 독립적으로 운영되고 있지만, 실제로는 연방정부가 지역경찰에 많은 영향력을 행사하고 있다. 연방헌법상 주(States)가 형사사법체계와 관련된 고유한 권한을 갖고 있지만, 연방정부도 연방예산을 활용함으로써 상당한 영향을 미쳐 왔다. 20세기 초반에는 주로 교육 및 업무 선진화 등 소극적인 지원 위주였다면, 최근 들어 군사용 무기 또는 첨단 감시 장비 보급함으로서 적극적으로 지역경찰을 변화시키고 있다. 이 과정에서 연방정부는 지역경찰의 구체적인 업무영역에까지 간섭하는 등 개입의 폭이 점차 광범위해져 가고 있다. 최근 트럼프 행정부의 이민정책 관련 행정명령 사례는 이로 인한 갈등이 증폭된 사례라고 할 수 있다. 지난 20여 년간 우리나라에서도 자치경찰제 도입관련 많은 논의가 있었고, 미국식기초 자치단체 중심의 자치경찰제도도 도입 가능한 모델 중의 하나로 검토된 바 있다. 하지만 실제 미국식 자치경찰제의 현실보다는, 다소 추상적인 현황 및 제도 위주로 논의된 면이 있다. 자연스레 기초 자치단체 위주의 자치경찰제에 대해 막연한 우려가 많았고, 중앙정부의 역할에 대한 발전적인 논의가 부족했던 것이 사실이다. 본 연구는 미국 연방정부가 지역경찰에 미치는 영향력과 그 실제 사례들에 대해 살펴보고, 우리나라의 자치경찰제 논의에 줄 수 있는 시사점을 도출한다.
Although the American local police system is operated independently, in reality, the federal government has substantially influenced on the local police. Even though the Federal Constitution is construed as granting States powers related to the criminal justice system, the federal government has had a considerable influence indirectly through the distribution of the federal budget. In the early 20th century, the influence had mainly focused on support for education and management of local police department. However, recently, the federal government has gradually changed the local police by spreading military weapons or advanced surveillance equipments. In this process, the federal government is becoming more involved in local police, including intervening in their own works. The dispute arising from President Trump’s executive order on immigration policy has amplified the potential conflict between the federal government and local police. For the past 20 years, there have been many discussions on the introduction of the local police system in South Korea. And the American autonomous local police system has been examined as one of the models that can be adopted. However, most of discussion ended in somewhat abstract description, instead of exploring the reality of the American system, Therefore, there was a vague fear with respect to the American system centering on the autonomous local police system, and there is currently lack of productive discussion on the role of the central government. This study examines the influence of the American federal government on local police and their actual cases, and looks for implication that can be given to the discussion of the local police system in South Korea.
