완전한 방임 혹은 완전한 통제는 불가능하기 때문에, 자유와 규제는 불가분의 관계에 놓여 있다. 자유 없는 규제도 규제 없는 자유도 존재하지 않는다. 즉 자유와 규제는 자신의 영역을 서로에게 허용한다. 이런 현실에서 우리나라의 선거운동 규제 패러다임은 근본적인 변화를 요구받는다. 즉 과거 공정성에 기반한 선거관리를 자유에 기반한 선거운동으로 전환하는 것이 그것이다. 이 연구는 표현의 자유의 시각에서 온라인 선거캠페인 규제 제도의 개선을 고찰하였으며 그 함의는 다음과 같다. 첫째, 민주주의라는 인류 보편의 가치와 정합하는 패러다임, 즉 선거관리의 공정에서 선거운동의 자유로 무게중심을 이동해야 한다. 둘째, 공직선거법 개별 조문에 대한 선택적 개선을 넘어, 기간·주체·방법의 편재를 근본적으로 개혁해야 한다. 다만 온라인 캠페인에서 시민참여를 제약하는 조문들은 우선 개정할 필요가 있다. 셋째, 선관위와 내용규제 중심의 선거운동 관리를 탈피하여 시민 중심의 규제 거버넌스를 창안해야 한다.
Freedom and regulation has a inseparable relationship. There is no freedom without regulation or freedom without regulation in socio-political world. In this respect, Korea's regulatory paradigm of the election campaign is called for rapid change. In other words, the paradigm of election must accept freedom and fairness as integrated values. In particular, the Korean election law should shift the center of gravity toward promoting the freedom of election campaign. And It should activate the freedom of online campaigning. Because online is a very broad communication channel, harsh control over it means infringement of freedom. So this study examines the problems of the Korean election law centering on the online campaign, and then proposes the major reform agenda and strategies.
