이 글은 2016년 한 해 동안 대법원이 다룬 민사(채권법)에 관한 판결 중 필자가 중요한 의미가 있다고 판단하여 임의로 선정한 주요 판결 9개를 대상으로 하여 그 판결을 소개하고 그 판결에 대해 해설한 것이다. 지명채권양도, 채권자취소권, 신뢰이익 배상, 위임, 주택임대차의 대항력, 하수급인의 저당권설정청구권, 자동차손해배상보장법 제3조의 타인성, 토양오염 유발자의 불법행위책임, 개인 사업주의 일실수입 등에 관한 판결에 대하여 이를 소개하면서 간단한 평석 내지 해설을 한 것이다.
This article is an analytic review on major 9 rulings from judgments on civil cases(law of obligations) which the writer randomly selected among the cases handled by the Supreme Court during 2016. The writer analyzed and criticized some important cases on various subjects including The Assignment of a nominative Claim, Obligee’s Right of Revocation, Trust benefit, Mandate, Requisite for Setting up of The Right of Lease, Other people of The Automobile Accident Compensation Security Law article 3, Lost profits.
