사이버공간의 확산과 함께 모욕적인 표현행위들도 급격히 증가하고 있다. 지난2008년 악플로 인한 유명연예인의 자살사건을 계기로 사이버모욕죄 신설에 대한 법률안이 국회에 제출되었으나 이후 수많은 논의들과 부정론이 확대되면서 표류하게되었고, 최근에는 오히려 모욕죄와 명예훼손죄 자체를 형사처벌에서 삭제하는 법률안이 발의되는 상황에 이르게 되었다. 그러나 사이버공간의 일탈적인 표현행위들이 나날히 증가하고 다양해지고 있는 상황에서 침해적인 결과를 초래하는 모욕행위들을 표현의 자유라는 명제하에 비범죄화하는 것은 바람직하지 않다. 특히 이러한 문제들이 정치적으로 쟁점화 하여 대립양상으로 나타나는 것은 무척 아쉬운 일이다. 오늘날 형사사법의 과제가 절대권력의 규제도구로서 범죄자의 처벌에 중점을 두었던 것으로부터 피해자를 배려하는 회복적 형사사법으로 변모하는 현실을 고려할 때사이버모욕죄를 신설하되 기존의 모욕죄보다 벌금형의 법정형만 상향조정하고 반의사불벌죄로 개정하여 가중처벌의 내용을 최소화하는 것이 바람직할 것으로 생각된다. 이를 통해 사이버공간의 모욕적인 표현행위에 대해 선언적으로 가벌성을 확대하고이러한 행위들이 사회적으로 금지되는 행위라는 점을 명백히 하는 일반예방적인 효과를 부여할 필요가 있다고 생각한다. 다만 실무적으로는 교육적인 목적을 가진 다양한 보안처분등을 함께 병행하여 형벌부과위주의 처벌만능주의가 되지 않도록 배려하는 것이 필요할 것이다.
With the expansion of cyberspace, acts of insulting expressions are rapidly increasing. A famous entertainer committed suicide in 2008 because of malicious comments. With this as the momentum, a new legislative bill on the establishment of a new cyber insult crime was proposed in the National Assembly, but the bill was set aside as many discussions and disagreements grew. Recently, a bill to remove insults and defamation from the subjects of criminal punishments was submitted instead. It is not proper to decriminalize acts of insults which cause violations under the guise of freedom of expression when deviant expressions in cyberspace are becoming more varied and increasing as the days go by. In particular, it is unfortunate to make this into a political issue and cause conflicts. When considering that the task of today’s criminal justice system has changed from being a regulatory tool of absolute power for punishing criminals into restorative criminal justice considering the victims, cyber insults should be newly established as a crime, with statutory fines set higher than those for the existing insult crime, and it should be a crime where someone cannot be punished against the will of the victim to minimize aggravation of punishments. Through this, acts of insulting expressions in cyberspace should be proclaimed to be punishable, and there is a need to create a general preventive effect clearly stating that such acts are socially prohibited. Practically speaking, however, various security measures, etc., with educational purposes should be performed in parallel in order to prevent the belief that giving punishment and penalties is best.
