인터넷 상황 하에서는 인터넷 상의 법률적인 분쟁을 넘어 거의 모든 일상적인 법률행위가 컴퓨터를 통해 이루어지고 있어서 분쟁해결에 있어서 컴퓨터 증거가 매우 중요한 역할을 수행하게 된다. 기업 간의 분쟁도 대다수 인터넷상의 증거를 요구하고 있다. 미국은, 연방 민사소송법(FRCP, Federal Rules of Civil Procedure)의 개정을 통해 e-Discovery 개정안이 발효되면서 모든 민사 소송에서 디지털 포렌식 도구를 이용하여 디지털 증거를 확보할 것을 의무화하고 있다. 우리 대법원도 비록 형사사건이지만, 컴퓨터의 전자적 증거가 갖는 제반 특성 때문에 적법한 절차와 방법에 따라 수집된 증거에 대해서만 증거능력을 인정하고 있다(대결 2011. 5. 26. 자 2009모1190). 우리 사회는 기존의 법과대학을 폐지하고, 법학전문대학원 체제를 출범한지 9년차를 맞이하고 있다. 법학전문대학원의 출범은 다양한 학문적 배경을 가진 학생들에게 소송실무를 습득케 함으로써 전문소송에 대비하자는 측면이 강하지만 아직 포렌식 교육은 초보수준이다. 점차 과학수사분야나 기업의 준법경영이라는 측면에서도 컴퓨터 포렌식은 중요성이 날로 높아가고 있다. 그런 점에서 우리 보다 앞서 가는 미국에서 컴퓨터 포렌식을 정규 과목으로 개설하는 대학의 교육목표는 무엇이고, 교과과정은 어떻게 구성되어 있는지를 살펴 우리에게 시사하는 바를 따져보는 것도 의미있는 행보라고 할 수 있다. 본 연구에서는 주로 컴퓨터 포렌식 분야의 인재상, 교육방법이나 교과과정에 대해 주로 살펴보았다. 향후 학제간, 학문영역간 융복합 교육에 있어서 하나의 모델이 되기를 기대해 본다.
In ‘cyber-space’, any actions, including conflicts among users, that take place on a daily routine, are generated through computers we use everyday, making the computer-based evidence, also known as, digital evidence, very crucial to solving such conflicts. Further, it plays an important role in solving business conflicts between companies as well. After ‘e-Discovery’ came into effect, the revised United States Federal Rules of Civil Procedure, also known as, FRCP, now requires securing of digital evidence through digital forensics in every civil procedure cases. The Supreme Court of Korea also recognizes admissibility of digital evidence, accepting it as crucial evidence to certain criminal procedure cases, under condition that it has not been acquired unlawfully. It has been 9 years since Law School (Graduate Level) program is established and College of Law (Undergraduate Level) discontinued its program. Law School trains students from diverse academic backgrounds and prepares them for professional procedure cases however, its forensics program is not yet established and implemented well. Importance of computer forensics is enforced more and more regarding forensic science and business compliances. Thus, it is necessary for us to look closely into the purpose of universities in the US that established computer forensics program and look closely into the details of their programs. In this research paper, we have looked into procedures, core studies, and 'fit' of the program (types of students that may be appropriate and qualified for the program). I hope this research be helpful to those establishing interdisciplinary studies program in the future.
