이 논문은 해롤드 버만(Harold J. Berman, 1918-2007)의 역사 법학(historical jurisprudence)을 한국에 소개하는 것이 목적이다. 논문의 순서는 그의 사후에 이루어진 종합적 평가를 먼저 소개하고, “서양법 전통”을 중심으로 한 버만 법학이 한국에서 어떤 의미를 가지는가를 음미한다. 논문의 후반은 버만의 “서양법 전통”의 형성과 변용의 진화 과정, 그리고 그의 “역사적 접근법”(historical approach)을 적용할 수 있는 예로, 동유럽 러시아 혁명(1989년 가을) 직후의 성찰을 들고, 논문의 마지막 부분에서는 버만의 “역사적 접근법”(historical approach)은 그의 사후에 어떻게 계승될 수 있는가를 묻는다. 그래서 그의 “치유와 쇄신”(integrare, integratio)을 위한 역사적 접근의 예로, 1997년 이후의 두 번의 경제위기 즉, 동아시아 외환위기와 2008년 세계금융위기를 든다. 필자는, 필자의 다른 저작인 『법과 경제』 3부작에서, 버만의 통합적인(integrative) 역사적 접근을 주된 방법론으로 썼다는 것을 설명한다. 논문의 결론은 버만의 역사관을 소개하고 있다. 즉, 법을 경제의 함수로 본다든가, 혹은 정치 권력의 함수로 보는 어떤 통념도 부인하고, 법의 변화는 정치와 경제의 함수가 아니라, 정치와 경제 변화가 법의 함수이다. 이 법의 진화는 종교와의 상호 역동적 관계에서 진행된다는 것이다.
The object of this article is to introduce Harold J. Berman’s historical jurisprudence to Korean academic circle. (Prior to this article, the author has introduced Harold Berman’s main achievements; The Interaction of Law & Religion to Korean academic circle in 1992, Law & Revolution-the Formation of Western Legal Tradition in 2013, and Law & RevolutionⅡ-the Impact of the Protestant Reformations on the Western Legal Tradition in 2016.) In this article, at first, overall and synthetic evaluations on his life-long achievement after his death in 2007 are dealt with. In this article, his role and contribution are characterized as “the bridge between East & West”, “Succession and Integration”, “Creating Integrative jurisprudence centered upon historical jurisprudence”, “Finding fountain of universalism”, “Overcoming nationalism and statism”, “Recurring percussion after German Unification”, “Influence in the field of ‘Law and Religion’.” Then, what does his jurisprudence with emphasis upon “Western Legal Tradition” mean to Korean jurisprudence? Korean jurisprudence has known classical classification of world legal families(civil-continental, Anglo-American, and Socialist), but lacks of understanding “Western Legal Tradition” and “Higher Law Tradition in the West.” In this article, the latter part of the article includes following items. The formation and evolution of Berman’s “’Western legal Tradition”. The application of his “historical approach” to the reflection of 1989 East European-Russian Revolution. Then, how can we succeed his “historical approach”? For example, in this article, the writter has adopted his “historical approach for healing(integrare) and renewal(integratio)” to explain two economic crisis, 1) 1997 Foreign Exchance Crisis of East Asia and 2) 2008 World Credit Crisis. In conclusion part, Berman’s ultimate view of law and history is dealt with. Law is not dependent upon economics and politics, rather economics and politics are dependent upon law. And the interaction of law and religion has mattered in the evolution of law.
