자연권을 거부한다는 것은 모든 권리가 실증적 권리라고 말하는 것과 같다. 왜 자연권이 자유와 평등의 이름으로, 혹은 그 배경 속에서 찾아지는가? 그것은 권리이론의 역사와 무관하지 않다. 하트가 정의한 자연권은 “모든 사람들이 자유로울 평등권”(the equal right of all men to be free)이다. 하트에 따르면 자연권은 간섭/지배/침해를 받지 않는 자유로운 상태로부터 확보된다. 자연권은 다른 사람의 자의적인 행위에 의해서 만들어진 권리가 아니다. 근대의 홉스적 자연권은 불간섭(non-interference)의 자유라는 소극적 자유론의 선구자로 알려져 있다. 자유의 개념은 이사야 벌린의 적극적/소극적 자유개념이라는 구분을 넘어서 ‘비지배의 자유’라는 제3의 공화주의적 자유개념까지 발전되고 있다. 이 글은 지배의 부재상태 즉 비지배(non-domination)라는 페팃의 공화주의적 자유개념을 통해 자유와 평등의 배경을 가진 자연권을 사유한다. 자유와 평등의 자연권은 특히 페팃의 역통제의 패러다임을 통해 논증하고자 하였다. 자연권을 비지배라고 사유하는 공화주의적 관념에 따를 때, 자연권이 가지는 은폐성을 가시적으로 보여준다.

Hobbes’s natural rights characterized by the right to negative freedom as non-interference is known to modern negative freedom theory. A third republican conception is the conception of freedom as non-domination. This paper regards the third republican freedom on the background of freedom and equality as the sound natural rights. I have tried to reason the ideal of liberty and equality in the natural right which has non-protection by concealment , through the “counter-control” paradigm in the P.Pettit’s republicanism.
