우리나라와 같이 국가경찰을 단일한 체계로 운영하지 않고, 육상경찰과 해양경찰로이원화하여 운영하는 체계 하에서는 육상경찰과 해양경찰의 직무의 내용 및 관할의 범위가 명확하게 획정되어야 한다. 그렇지 않다면, 어느 장소에서는 서로 직무수행을 미루게 되는 일이 발생할 수 있고, 어느 장소에서는 양 기관이 중복적으로 직무를 수행하게 되는 일이 발생할 수도 있을 것이다. 육상경찰과 해양경찰의 직무와 관련하여 첫 번째 육상경찰의 직무인 “치안에 관한사무”와 해양경찰의 직무인 “해양에서의 경찰 및 오염방제에 관한 사무”에 대한 정의가현행 법률에는 나타나 있지 않다. 이에 대한 명확한 정의가 법률적으로 필요하다고 본다. 또한 육상경찰과 해양경찰의 직무를 “치안”과 “경찰”로 각각 나눠서 규정해야 할 이유가 있는지 의문이다. 이를 어느 한편으로 통일하여 규정할 필요가 있다고 본다. 두 번째 육상경찰의 직무의 내용과 관련하여 경찰법과 경찰관직무집행법에서 이중으로 규정해야 할 이유가 있는지 의문이다. 그와 관련한 규정을 경찰의 직무에 관한 법률인 경찰관직무집행법에만 둘 필요가 있다고 본다. 세 번째 해양경찰은 육상경찰과 마찬가지로 경찰공무원법의 적용을 받는 국가경찰공무원이다. 따라서 육상경찰의 경찰법과 경찰관직무집행법에 대응하는 해양경찰의 해양경찰법과 해양경찰관직무집행법의 제정이 필요하다고 본다. 한편 육상경찰과 해양경찰의 관할의 범위와 관련하여 첫 번째 정부조직법 제34조 제4항과 경찰청 직제 제3조에 “육지에서”라는 문구를 추가하고, 그에 대한 명확한 정의규정을 둘 필요가 있다고 본다. 두 번째 해양경찰의 관할의 범위를 규정하고 있는 정부조직법.해양경비법.해양경찰청 직제에서 해양에 대한 정의규정을 두고 있지 않다. 따라서 해석론상으로는 .해양수산발전기본법. 제3조 제1호와 .해양사고의 조사 및 심판에 관한 법률. 제2조 제1호및 .수상레저안전법. 제2조 제7호에서 규정하는 해양과 내수면의 정의를 토대로 하여해양경찰의 관할의 범위를 획정할 수밖에 없다. 이에 따라 내수든 영해든 물이 존재하는 장소는 해양경찰의 관할의 범위에 속하고, 바닷가 근처라고 해도 물이 존재하지 않는 장소인 섬 그 자체는 육상경찰의 관할의 범위에 속한다고 할 수 있다. 입법론적으로는 섬과 같은 육지지역을 포함하는 해양경찰의 관할의 범위인 해양에 대한 명확한 정의규정이 필요하다고 본다.

There are several problems associated with the duties of police and maritimepolice. Firstly, a clear definition on the duties(namely work on the security or workon the police in the ocean and prevention of pollution) of the police and maritimepolice isn't specified in the current laws. The regulation on a clear definition ofduties is required. Secondly, the content in regard to the duties of police is specified in the PoliceAct as well as Act on the Performance of Duties by Police Officers. The contentin regard to the duties of police must be defined in the Act on the Performanceof Duties by Police Officers. Thirdly, not only police but also maritime police is national police officer. Thus,Maritme Police Act and Act on the Performance of Duties by Martime PoliceOfficers should be enacted. There are several problems associated with the sphere of jurisdiction of policeand maritime police. Firstly, “in land” should be added in the regulation of the National GovernmentOrganization Act and police related laws associated with the sphere of jurisdictionof police. Secondly, a definition on the “in the ocean”, the sphere of jurisdiction of themaritime police isn't specified in the current laws. The regulation on a cleardefinition of “in the ocean” is required.
