행위자에게 형법상의 상해죄를 적용하면 벌금형 선고가 가능해지는 반면, 폭력행위등 처벌에 관한 법률상의 ‘특수상해죄’가 적용되면 3년 이상의 유기징역만이 선고될 수있다. 한 개인이 단체나 다중의 위력을 이용하지 않고 타인에게 상해를 가함에 있어 가중처벌이 가능해지는 기준은 ‘흉기 기타 위험한 물건을 휴대’하여야 한다는 점이다. 그런데, 가중처벌의 결정적 기준이 되는 ‘위험한 물건’이 명확하지 않은 개념이라는 문제제기가 있어왔다. 특정 개념이 명확한 개념인지의 여부는 존재론적으로 언어 기호 자체에 내재해 있는것이 아니다. 오히려 필연적으로 모호할 수밖에 없는 법률언어가 보다 많은 이들에 의해 높은 수준의 합의를 이루게 되면 얼마든지 명확한 개념이 되는 것이다. 이렇게 의사소통적 현상으로서 명확성원칙을 바라보게 되면 개념을 가리는 기준 제시와 그것을 채우는 유형화 작업이 중요해진다. 본 글은 ‘특수상해죄’의 구성요건인 ‘위험한 물건’은 상당한 반위해적 이용이 가능한물건인지를 기준으로 삼고, ‘휴대하여’의 개념에서 실제로 이용된 방식을 판단하는 것을 제안한다. 물론 이러한 기준 제시가 개별적인 사안들에서 이견 없는 결론을 도출해내주는 것은 아니다. 하지만 이렇게 나누어진 기준으로 세분화되는 유형화 작업이 법관을 통해 확고해지면 그 개념은 더 이상 모호한 개념이 되지 않을 수 있다. 검사와 피고인 측을 포함하여 일반 시민들에게도 ‘위험한 물건을 휴대했는지’에 포섭시킬 수 있는사안인지에 대해 예측가능성이 확보된다면 그 개념은 이미 가치판단의 소통이 이루어진 ‘명확한’ 개념이 되는 것이기 때문이다.
While Criminal Law imposes not only imprisonment for a term not exceeding7 years but fines not exceeding 10,000,000 won on a person who commits battery,Special Act for the Punishment of Violent Act imposes only imprisonment morethan 3 years and not exceeding 30 years on a person who is considered to commitaggravated battery. A standard to impose the aggravated penalty requires oneto commit battery with ‘carrying a dangerous weapon.’The principal of legal certainty does not mean to select ontologically definiteterm, which is unattainable idea. Rather, the principal can be responded byreaching a high level consensus among citizens on meaning of the term. Fromthis communicative point of view, it would be important to present a standardto concretize the term and classify the individual facts. This article suggests as follows: (1) ‘dangerous weapon’ to be decided bywhether it is designed to be capable of substantially unharmful uses, (2) ‘carrying’to be judged by actual way of use. Surely, this suggestion does not rule out allthe ambiguity that ontologically resides on every single word. However, if thenarrowed-down notion is accepted by more members of society throughclassifying which has been shown in this article as an example, ‘dangerousweapon’ would no longer be an ambiguous term.
