유럽소액사건심판제도는 유럽연합 가입국 간의 민사 및 상사에 관한 소액사건을 간소하고 신속하며 경제적으로 처리하기 위한 목적으로 도입되었고, 가입국 간의 소규모거래가 활발하게 이루어질 수 있는 하나의 기반이 될 것으로 기대를 받았으며, 최초의유럽연합 자치절차 중 하나로 평가받고 있다. 그리고 이에 따라 진행된 사건에 소요된시간과 비용이 크게 절감되었고, 동 절차를 활용한 당사자의 상당수가 이에 대한 만족을 표하고 있다는 점에서 그 가치를 인정받고 있다. 유럽소액사건심판제도는 유럽연합 가입국 간의 소액사건을 해결하기 위한 제도라는점에서 국내에 한정된 우리 제도에 비교적 새로운 아이디어를 제공해 줄 수 있다. 또한동 제도의 시행 후 유럽소비자센터는 실제로 동 제도가 얼마나 효과를 내고 있는지에관한 연구를 진행하였고, 이를 토대로 여러 가지 문제제기와 함께 나름의 권고안을 제시하였으며, 유럽위원회 역시 실무상 동 절차가 제대로 활용되지 못하고 있다는 지적에따라 이를 개선하기 위한 목적으로 유럽소액사건심판절차에 관한 규칙 개정안을 제출한 바 있다. 즉 제도의 시행 후 나름의 평가와 연구를 거쳐 개선점이 도출되었고, 관련문제를 보완하기 위한 규칙 개정안까지 마련되어 있어 제도의 일련의 변화를 확인할수 있다는 점에서 어떠한 요소가 무슨 문제를 유발하는지를 미리 확인할 수 있다. 이에 본고는 유럽소액사건심판제도의 도입배경을 정리하고, 동 제도의 주요내용과최근의 평가 그리고 개선에 관한 내용을 정리하여 검토한 후 이를 토대로 동 제도를 평가하고 그 시사점에 대해 검토하였다.

The European Small Claims Procedure(ESCP) which is one of the first to createautonomous European procedures aims at simplifying, speeding up and reducingthe costs of litigation concerning small claims in cross-border cases in the EUMember State. According to evaluation of the ESCP regulation, it has contributedto a reduction of the costs of litigating cross-border small claims, and of theduration of litigation, and lots of those who had used th procedure are overallsatisfied with it. ESCP concerning small claims in cross-border cases would offer new ideas intothe domestic small claims procedure. Also there are the problem posing andrecommendation of European Consumer Centre(ECC) which is the result of studyand research of several ECC and the draft of ESCP rules of the EuropeanCommission to solve the problems. That would inform of changes which includeproblem and solution. Therefore this article reviewed the introduction background,main contents, changes and implications of ESCP.
