본 연구는 바이오뱅크를 사용하고 있는 의과학 연구자들이 실질적으로 어떤 어려움을 겪고 있는지를 규명하여 그 전망을 제시하고자 하였다. 그 결과, 대부분의 연구자들은 다양하고 모호한 법적·윤리적 갈등을 경험하면서도 충분한 설명에 근거한 동의(informed consent) 원칙을 지키고 있었다. 기존의 바이오뱅크 정의에 비추어볼 때, 바이오뱅크는 본연의 역할을 충분히 다하지 못하였고, 대부분의연구자들은 충분한 설명에 근거한 동의 원칙의 엄격한 적용으로 인해 운영상 어려움을 겪고 있었다. 특히 의과학 연구자들에게 연구자간·국가간 자료공유 및 사용은 다른 어떤 것보다 중요한 이슈로 인식되었다. 한편 자료 제공자에 대한 혜택분배 여부에 대해서는 찬성과 반대 입장이 공존하였다. 결국 바이오뱅크의 성공적 운영은 제도화로 귀결되는 바, 이를 위해 첫째 우리나라 바이오뱅크 정책이 추구하는 뚜렷한 방향이 설정되어야 하고, 둘째 구체적 방안으로 바이오뱅크 시스템의 정비,포괄적 동의제도 도입, 혜택 분배에 대한 사회적 논의, 연구자의 법적·윤리적 갈등을 줄이기 위한노력 등이 요구한다. 셋째, 국민(시민)을 포함한 연구자, 국가간 사회적 합의와 신뢰를 근간으로 한제도적 장치가 마련되어야 하고 넷째, 바이오뱅크 관련 주요이슈를 총괄하는 통합채널을 마련함으로써 연구자들이 중요한 윤리적·법적·사회적 함의(ELSI)를 인식할 수 있어야 한다.
This study aims to identify the principal issues and prospects of biobankmanagement based on a survey of 13 researchers. The survey was conducted inOctober 2012 using questionnaires with open-ended questions. The main resultsare as follows: Most respondents followed a procedure of informed consentdespite experiencing various (often ambiguous) legal and ethical difficulties. Domestic biobanks are not satisfied with the definition of “biobank” proposed bythe existing research. Broad consent was considered indispensable if it could becomplementary to the principles of informed consent. Data sharing amongresearchers or countries was perceived to be one of the most important aspectsof biobank management. It was similar to numbers between the support and theopposite of distribution of benefits to donors. The institutionalization of biobankswas left as a task to be worked out in the future. For a biobank to be successful,it is necessary to establish a clear policy direction and to make concrete efforts(reorganization of the biobank system, implementation of broad consent, socialdiscussion of benefit sharing, and efforts for reducing researchers’ legal andethical conflicts). Policies must be prepared using institutional strategies on thebasis of public consensus and trust among citizens, researchers, and thegovernment. Finally, it is necessary for researchers to recognize the social, legal,and ethical implications of biobank management by setting up an integrativechannel to inform researchers of important issues regarding biobank policies.
