Korean Society is aging rapidly. In Korea, the population of the aged accounts for 9.5 percent of the total population as of 2007. This aging rate is quiet without precedent. In proportion to this rapid aging rate, an increasing number of the aged suffer from severe mental and physical disorders, such as dementia, palsy, and so on. When all kinds of nuclear families increase and a growing number of women engage in an activity, it is difficult to take care of the old patients at home. Therefore, the problem with long term medical care for the old and its heavy burden of cost is an urgent social one. According to the principle of social joint responsibility, the government and the society have been preparing for the introduction of the long term care insurance system, as a solution to the problem with nursing and long term care for the aged and the disabled, in order to enforce it in July, 2008. However, the law of the long term care insurance for the aged which has been passed in this session of the National Assembly is thought to have some weak points and need to make up for them. The first question is whether it is right that this system is insurance or that it is security. The second question is who is an enforcement agent for this system. The third question is whether it is right to pay a fee of medical treatment by treatment, or by person. This study is to inquire into the necessity of the long term care insurance, research foreign long term care insurance systems, and analyze the law of long-term care insurance that has been passed in the National Assembly to suggest the answers to the questions.
