2015년 3월 27일 경제활성화법 일환으로 지속 논의되어 온「클라우드 컴퓨팅 발전 및 이용자 보호에 관한 법률」이 제정되어 2015년 9월 28일 본격적인 시행에 들어가면서, 그동안 해외에 비해 협소했던 국내 클라우드 컴퓨팅 시장이 크게 확대될 것으로 전망되고 있다. 클라우드 컴퓨팅은 가상화(virtualization) 기술 및 분산처리 기술을 기반으로 네트워크가 연결된 곳이라면 어디에서든지 시공간을 초월하여 방대한 규모의 정보를 저장 및 처리할 수 있도록 지원해준다. 클라우드 컴퓨팅 환경에서 제기되는 개인정보법상 문제들은 서비스 구현에 있어 발현되는 핵심적인 특징들과 밀접한 관련이 있다. 클라우드 컴퓨팅은 ‘분산된 IT 자원에 대한 네트워크상 협력을 통한 효율 달성’과 ‘정보 위치의 모호성 및 이용자 정보 통제 불가능’이라는 상반된 측면을 동시에 가지므로 클라우드 환경에서 이용자의 개인정보자기결정권에 대한 심각한 위협을 초래한다. 또한 개인정보처리자라고 해서 이를 완전히 통제하기도 어려워 개인정보의 유출 사고 발생 시 법적 책임을 명확히 하는 것이 쉽지 않다. 최근 신설된 클라우드 컴퓨팅 발전법은 개인정보 보호에 관하여는 기존의 개인정보 법제를 준용하도록 규정하고 있다(법 제4조). 이에 따라 개인정보와 사적정보의 구분 필요 여부, 서비스 유형별 다양한 법률관계로 인한 해석 논의, 개인정보처리(제3자 제공·취급위탁·국외 이전 문제)에 있어서 명확한 해석기준 마련, 정보 통제 어려움으로 인한 이용자 권리의 실질적 강화방안 등은 여전히 해결해야 할 현안으로 남아있다. 규제당국은 기존에 운영되고 있는 인증제도를 글로벌 기준에 부합하도록 설정하고, 해외에 서버지를 구축한 국내 CSP 혹은 외국계 CSP 등도 자발적으로 개인정보 보호 정책을 수립할 수 있도록 하여 개인정보 보호의 강화를 유도할 필요가 있다. 특히 클라우드 컴퓨팅은 국외 이전 문제가 결부되어 있는 만큼 국가 간 정보보호 수준을 조율하고 공조체제를 형성하는 데에도 국가적 차원의 노력이 필요할 것이다.

And cloud service user can be offered various service by outsourcing ICT resources various service from cloud service offerer instead of expelling physical ICT infrastructure directly. The terminology 'Cloud Computing' can be understood as a kind of paradigm change that a new period using internet, software and management equipment for existing twenty years comes. The issues about individual information act caused by cloud computing environment have connection with the heart of features in materializing technology. Above all, cloud computing has side to both efficiency achievement through network cooperation against dispersed IT resources and vagueness of information position & information control impossibility of user. The threat against individual information self decision competency is occurred in cloud environment. And it is not easy to prove responsibility clearly when effluence accident of individual information is occurred, because individual information manager can't control entirely. Cloud service offerer has a legal position as an added communication enterpriser by「electricity communication enterprise act」, an individual information manager by「individual information protection act」, an information communication service offerer by 「information communication act」, and a cloud computing service offerer by「cloud development act」without relations with concrete contents of service. Cloud service utility enterprise makes an official contract through the cloud utility contract with CSP for offering service to the last user. Therefore the service utility enterprise is responsible for obligation nonperformance by contract or unlawful act by civil affairs in case that cloud relation service stops or it does harm to the last user, for example, dater effluency and damage. Cloud computing development act doesn't solve the present institutional problems. We don't solve the various issues, as an example, necessity in dividing individual information and private information, variety solution of legal relation by service type, clear standard of analysis in individual information management, and practical strengthening of the user right caused by difficulty of information control and so on. And also it is necessary for us to institute the various authentication institutions which were fit in with global standard, and to protect individual information by strengthening authentication institution utility. Especially, we should make efforts to tune the information protection level between nations, because cloud computing has relation to the problem of abroad move.
