기성세대의 임무 가운데 하나는 청소년들이 건강하고 온전한 인격체로 성장할수 있도록 최선의 노력을 다하는 것이다. 그러므로 이를 위해 청소년 유해환경에대한 통제하고 정화하는 것은 매우 중요한 일이다. 하지만 최근 들어 아날로그사회에서 디지털 사회로 전환되어 가면서 청소년 유해매체물과 관련된 문제점들이부각되기 시작하였다. 이를 통제하기 위해 과거의 아날로그식으로 접근하는 것에대한 한계가 드러났기 때문이다. 특히 청소년 유해매체물과 관련된 규정을 위반하는 경우에는 형사처벌이 될 수 있기 때문에 기성세대의 이익과 청소년 보호의균형점을 찾아서 이를 청소년 유해매체물과 관련된 형사정책에 고려를 할 필요가있다. 이런 관점에서 본 논문은 최근 논란이 되고 있는 청소년 유해음반, 청소년유해게임물, 청소년 유해비디오물과 관련된 사안들을 다루고 있다. 이런 사안들은청소년보호법에 규정되어 있는 형사처벌 규정과 관련이 되어 있기 때문에 정해진규정을 위반한 자는 청소년 보호라는 정책적인 이유로 인해서 형사처벌이 될 수있다. 이처럼 정책적인 이유로 사람을 처벌하는 경우 처벌의 정당성을 확보하는것이 매우 중요하다. 그로 인해서 청소년 유해매체물에 대한 형사정책에 있어서중요한 것은 청소년 유해매체물 기준절차의 정당성을 확보할 필요가 있다. 또한청소년 유해매체물의 유통이나 접근에 실질적인 효과를 얻기 위해서는 ISP에 대한적절한 책임분배가 요구된다. 이는 ISP를 청소년 유해매체물에 있어서 단순한정책의 대상자로 처우하는 것에서 더 나아가 자율적인 당사자의 지위로 올려놓는것을 의미한다. 이와 함께 집단지성과 협력이 필요한데, 청소년 유해매체물의근간이 되는 사이버공간의 네이티브가 네티즌이기 때문이다. 그러므로 청소년 유해매체물에 대한 형사정책적 논의에서 이런 점들이 신중히 고려되어야 할 것이다.
The older generation has a responsibility to help adolescents to grow into healthy and mature adults. Therefore, it is important for adults to control and correct potentially harmful environments to the youth. As we move from analogue to a digital society, various problems have been found regarding harmful media content for minors. Apparently, there is a limit to our abilities to address those issues in an analogue way. Those who violate regulations regarding harmful content control for teens can be prosecuted. Therefore, it is important for us to find a balance between interest of the older generation and youth protection. And we should consider reflecting our findings into criminal policies regarding media content harmful to minors. This paper mainly deals with songs, games and videos harmful to minors which have been a much-debated controversy in our society. Those who violate the established rules on media content harmful to minors are prosecuted. From the point of view of criminal policy, it is important to find a justification for the punishment when a violator is punished. And what is also important from the viewpoint of criminal policies is to secure the justification for standards and procedures of harmful media content for minors. In addition, in order to bring practical and effective control to distribution of harmful contents,appropriate division of responsibilities of ISP is required. This means giving ISP the status of a directly involved party in setting policies and regulations regarding harmful media content rather than simply treating it as a policy object. Additionally, collective intelligence and cooperation is needed because netizens are native to cyberspace where materials harmful to minors can be found. Therefore, such views should be considered carefully in discussions on criminal policies regarding media content harmful to minors.
