우리나라의 범죄피해자보상제도는 향후 실질손해를 산정하여 보상하는 방식으로 변경되어야 하며, 현재 검찰에서 운영되고 있는 경제적 지원은 구조금과 통합하여 일원화된 방식으로 운영되는 것이 바람직하다고 본다. 2016년 검찰에서 운영하고 있는 범죄피해자에 대한 경제적 지원은 치료비 지원한도가 5,000만원으로 상향되었으므로, 그 금액도 적지 아니하고, 구조금과 중복가능성도 있으므로 앞으로 경제적 지원은 구조금의 체계 내에서 통일적으로 정비되어야 할 것이다. 그러한 통일적인 정비에서 현재 뉴질랜드가 운영하고 있는 모든 사고로 인한 상해에 대한 통합적인 보상 시스템은 우리나라의 경우에도 시사하는 점이 많다고 본다. 특히 뉴질랜드가 통합적인 보상제도를 고안함에 있어서 논리적 근거로 내세운 것 중에서, “빈곤이 중대문제였던 시대는 이미 지나가고, 국력에도 충분한 여력이 있게 되었으므로 사고에 대한 보상도 단순히 최저생활을 보장하는 정도의 것이 아니라 사고로 인하여 현실로 발생한 손해를 회복시키는데 충분한 것이어야 한다”는 점은 우리의 범죄피해자구조금 체계를 재정립함에 있어서도 참고해볼만한 부분이라고 생각한다.
The current system for compensation of criminal victims in Korea should be modified to the way of ensuring more realistic support for victims in consideration of practical financial loss of criminal victims. It is necessary to establish comprehensive assistance system by integrating current financial support provided by the Prosecutors‘ Office and the relief payment. In 2016, the maximum amount of compensation for a remedy which the prosecutors’ office decides for financial compensation to crime victims is revised upwards to 50,000,000 won. This amount of compensation is not inconsiderable and related to the relief payment there is another possibility that assistance is overlapped. Therefore, for effective financial restitution for crime victims, integrated victim assistant system is needed. In connection with new integrated assistance system, a government organization of New Zealand, The Accident Compensation Corporation(ACC) is well worth considering. ACC provides comprehensive, no-fault personal injury cover for anyone who is injured in New Zealand. Furthermore, establishing this comprehensive compensation system, New Zealand government lay out a logical basis as following; "a period of poverty that poverty is a serious social problem was already passed, the government budget is also satisfactorily prepared. In such respect, compensation and support for accidents and injuries should be enough to cover the practical financial loss of victims, not the minimum level of cost of living." This point of view could be useful for revising and improving our criminal victim compensation system.
