안전한 도시를 만들기 위해서는 무엇보다 아동과 여성들이 성폭력 범죄로부터 안전한 사회를 만드는 것이 중요하다. 그런데 최근 아동성폭력 범죄에 대한 대책들은 주로 전자발찌를 통한 위치추적, 신상공개 강화, 약물을 통한 성충동 억제, 법적 처벌조항 강화 등 사전 예방적 차원보다는 사후 대응적 측면이 강조되고 있다. 그리고 범죄에 대한 상황적 접근이 전혀 고려되지 못하고 있다. 본 연구는 최근 5년간 성폭력범죄와 아동 성폭력범죄 발생 현황에 대한 분석을 통해 상황적 범죄예방 차원에서 아동성폭력 범죄를 예방하기 위한 대안들을 모색해 보았다. 코니시와 클락이 제시하고 있는 25가지 상황적 범죄예방 기법들 가운데 아동 성폭력범죄에 활용할 만한 것들을 다음과 같이 제시하였다. 첫째, 아동 성폭력범죄를 예방하기 위해서는 아동 성폭력범죄자가 범죄를 쉽게 저지르지 못하도록 하는 노력증가 기법을 활용할 필요가 있다. 아동 성폭력범죄에 취약한 오후 시간에 아동 홀로 다니거나 주거지에 남아 있지 않도록 하는 대상의 견고화, 시설에 대한 접근통제 등이 필요하고, 놀이시설이나 공원 등에 대한 입구 뿐만 아니라 출구에 대한 검색, 성폭력이 일어나기 쉬운 학교나 구석진 장소에 대한 CCTV감시가 필요하다. 둘째, 잠재적 아동 성폭력범죄자로 하여금 범행시 누군가에게 적발되어 검거될 위험성을 높이는 기법을 활용할 필요가 있다. 방과 후 프로그램을 통해 학교수업이 끝난 후 홀로 남는 아동이 생기지 않도록 보호력을 증대하고, 어둡고 구석진 거리에 대한 조명을 밝게 하여 자연적 감시를 확대하고, 아동의 안전에 취약한 장소에 대한 감시를 늘리기 위해 장소관리자 운영을 확대할 필요가 있다. 셋째, 아동 성폭력범죄자가 범죄행위를 통해 얻을 수 있는 성적욕망의 해소와 같은 기대되는 보상을 감소시키는 기법을 활용할 필요가 있다. 아동 성폭력범죄의 대상이 될 가능성이 높은 취약한 아동이 쉽게 잠재적 범죄자의 눈에 띄지 않도록 하거나(대상은폐) 아동 성폭력범죄가 가장 많이 발생하는 시간인 낮 시간(12:00-18:00)에 주거지에 혼자 있지 않도록 하는 조치(대상제거)들이 필요하다. 넷째, 아동 성폭력범죄를 부추기는 자극들을 감소시키는 기법을 활용할 필요가 있다. 억압되어 있는 분노가 좌절과 스트레스가 많아지면서 성폭력으로 분출되지 않도록 생활주변에서 부드러운 조명이나 마음을 진정시키는 음악을 들려주고, 각종 성적 자극을 유발하는 요인들을 차단할 필요가 있다. 마지막으로 아동 성폭력범죄자들이 자신의 행동에 대해 그럴듯한 핑계로 합리화시키지 못하도록 변명거리를 사전에 차단할 필요가 있다. 가령 “아동이 너무 귀여워서, 손주 같아서” 등과 같이 변명을 하지 못하도록 어린이집이나 유치원 등에 규칙제정이나 지시사항 공고를 통해 유아에 대한 신체적 접촉 행위가 금지된 행동임을 명확하게 규정할 필요가 있다. 그리고 인지능력을 떨어뜨려 손쉽게 충동대로 행동하도록 하는 약물이나 알코올에 대한 통제가 이루어지는 것도 아동 성폭력예방을 위해 중요하다.
