공무수탁사인이란 공적인 임무가 부여된 사인으로서 행정주체의 지위에 놓인자를 말한다. 현대에 있어서는 행정기능의 확대에 따라 여러 가지 형태의 공무수탁사인이 등장하고 있는 바, 근래에는 지나치게 비대한 행정권을 축소, 간소화하는 작업의 일환으로서 공무수탁사인 내지는 사인에 의한 행정에 대한 관심이 높아지고 있는 것으로 보인다. 공무수탁사인은 위임자에 대하여 공무수행권과 비용청구권 등을 지니며 국가는 행정임무를 사인에게 맡김으로써 나타날지도 모르는 폐해를 방지하기 위하여 감독권을 가진다. 아직은 논의가 성숙되지 않은 공무수탁사인에 관한 연구가 활발해진다면 작은 정부이론이 실현되는 데 작은 밑거름이 될 수 있을 것으로 생각된다.
