This paper derives a corporation's demand for in-house counsel, emphasizing the corporation's effort to increase bargaining power by reducing trial costs. In-house counsel has scale economies because total saving of the supposed trial costs increases in cases, even though the cases will be settled without trials in equilibrium. A corporation's marginal disutility from cases decreases due to its scale economies.
본 논문은 기업들이 재판 비용을 줄여 공판전 협상에서 의 협상력을 강화하기 위한 의도에 초점을 맞춰 기업의 법무팀에 대한 수요를 도출하였다. 균형에서는 공판을 하지 않고 협상으로 타결되지만 가상적 공판비용의 절약이 사건의 수에 따라 증가하므로, 법무팀은 사건의 수에 대해 규모의 경제를 갖는다. 그리고 이러한 법무팀의 규모의 경제로 인해 기업의 사건에 대한 한계 비효용은 체감한다.
