本論文は、『性同一性障害者の性別の取扱の特例に関する法律』成立の背景と、同法律が、日本における異なる多様なトランスジェンダーの人々へ与えた影響を考察することを目的とする。トランスジェンダー当事者間、医学界、法曹界における運動や議論と、それらに対する国会議員による同調は、同法律がこの時期に成立するためには欠かせない要因であった。同法律は、日本におけるトランスジェンダーの人々の一部にとって、法的性を変更することを可能にした。しかしながら、それと同時に、トランスジェンダー当事者間の分断を深め、また加速化させもした。
This paper examines the background of the establishment of the “Act on Special Cases in Handling Gender for People with Gender Identity Disorder,” and the effects this Act had on variety of different transgender people in Japan. Movements and discussions among transgender people, in the medical world, in the legal and juridical world, and the sympathy of the members of the Diet toward these movements and discussions were indispensable for the Act’s establishment in 2003. This Act enabled some of transgender people in Japan to change their legal gender, however, at the same time, it deepened and accelerated the oppositions among transgender people.
