이 연구는 최근 많은 논란이 계속되고 있는 특허보세구역의 하나인 보세판매장의 성격과 특성을 분석한 것이다. 연구결과 최근 시내면세점 특허제도를 둘러싼 논란은 보세판매장의 성격과 특성을 오해한 데서 비롯된 바가 상당히 큰 것으로 나타났다. 관세법상의 입법취지에 따르면 보세판매장 제도는 외화획득과 관광진흥, 수출촉진, 고용증대 등의 공익적 목적을 목표로 운영되는 것으로 확인된다. 이는 보세창고나 보세공장 등 다른 특허보세구역과 구분되는 것이다. 분석결과 보세판매장에서 면세품을 판매하는 것은 영리활동에 해당하지만, 그렇다고 그 운영인에게 정부가 제도적으로 예외적인 특혜를 부여하는 것은 아닌 것으로 확인되었다. 면세점에서 판매되는 상품에는 총 10종의 소비세가 면제되고 있으나 누구든지 상품을 수출할 경우 보세판매장 면세품에 대한 것과 마찬가지로 이들 소비세가 면제되고 있음이 확인되기 때문이다. 보세판매장에서 해외여행객에게 판매된 물품은 전량 외국으로 수출된다. 따라서 이와 같은 상품판매와 수출행위에 대해 대외무역법과 관광진흥법 등의 규정을 적용할 경우 보세판매장은 산업분류표상 분류되는 종합소매업일뿐 아니라 무역업체이자 관광산업체에 해당하기도 한다. 보세매장 정책의 개발에는 보세판매장의 이러한 성격과 특성이 충분히 감안되어야 한다. 이 연구결과는 시내면세점 특허제도를 둘러싼 논란을 해소하고, 보세판매장 정책의 개발과 제도의 합리적 발전에 기여할 것으로 사료된다.
This study analysed the characteristic of duty-free shop that is one of the licensed bonded area. The results showed that current controversy which is surround with patent scheme of duty-free shops in downtown is based on misapprehension regarding characteristic of duty-free shop. According to the purpose of legislation, duty-free scheme is confirmed to target public objectives, such as acquisitions of foreign currencies, tourism promotion, export promotion and employment expansion. It is distinguished from other licensed bonded areas, such as bonded warehouse and bonded factory. Analyses results pointed out that selling duty-free goods in the duty-free shop is relevant to commercial activity, however, it is confirmed that the government did not administer an exceptional prerogative institutionally to operators. This is because, even though 10 kinds of excise tax to selling products in duty free shop of Korea is exempted from taxation, if anyone exports goods, its excise tax is also immune alike products in duty-free shop. The entire quantity of sold goods to overseas travellers in duty-free shop exported to foreign countries. Therefore, if the foreign trade act and tourism promotion act applied to sales and export, duty-free shop is not only general retail business which is distinguished on the industrial classification table, but it is also classified as a trading company and travel bureau.
