응용예술 저작물로서 건축저작물의 경우에도 산업상의 저작물 일반에 관하여 논의되는 점들이 마찬가지로 문제가 된다. 미국에서의 건축저작물에 대한 저작권 보호와 관련하여서는, 그 입법상의 독특한 역사 때문에 건축설계도, 모형과 그 3차원적인 표현물인 건축물로 나뉘어 논의가 이루어져 왔는데, 정도의 차이는 있으나 위 두 유형의 저작물 모두 저작권법상 보호 대상으로 해석되기는 하였지만 보호에는 한계가 있었다. 그러나 이 같은 상황은 미 연방의회가 1990년 베른협약 가입국으로서의 의무를 준수하기 위하여 건축저작물보호법(Architectural Works Protection Act of 1990, AWCPA)을 제정함으로써 상당한 변화를 겪게 되었다. 위 법률에 따라 건축저작물이 저작권법 §102(a)(8)에 독립한 보호대상 저작물로서 규정되면서 ‘건축물’이 보호대상으로 명시되고, 건축저작물에 관한 정의규정이 같은 법 § 101에 삽입된 것이다. 그렇지만 위 법률의 시행일인 1990. 12. 1. 이전에 완성된 건축저작물의 경우 위 법률에 의한 보호대상에서 제외되는데, 현존하는 상당수의 건축저작물이 위 법률 제정 이전에 완성된 것이므로, 위 법률 이전에 적용되던 법률과 그에 관한 판례들을 함께 이해할 필요가 있다. 즉 관련된 자료들을 이해함에 있어 1990년 개정 법률이 적용되는 사안인지 아닌지가 상당히 중요한 의미를 갖는다는 점을 염두에 두어야 한다. 구체적으로 이 논문은 위와 같은 이해를 전제로 1990. 12. 1.을 전후로 한 미국에서의 건축저작물의 범위와 보호범위, 건축저작권의 내용과 제한, 보호대상의 시적범위, 저작권 침해의 입증과 구제수단 등의 문제를 다루고 있다.


As works of applied art, architectural works present many of the same problems encountered in the discussion on industrial objects. There are aspects to the copyrightability of architectural works: the plans and models that represent the structure, and the architectural structure itself. Both received protection under copyright law, but that protection was limited. Architectural works were viewed as useful objects, subject to the same constraints discussed. This changed with the passage of The Architectural Works Protection Act of 1990. This legislation, designed to comply with Berne Convention obligations, conferred full protection on architectural structures and officially recognized that architectural works are the eighth category of copyrightable subject matter under § 102(a)(8). The Act, however, does not apply to architectural structures constructed before the effective date of the Act, December 1, 1990. Thus, it is necessary to understand the pre-1990 law governing architectural plans and structures for the overwhelmingly greater number of buildings constructed before that date. In the concrete, this article deals with scope of copyrightable architectural works and protection, contents and limitations of architectural copyright, verification of violation of architectural copyright and it's remedies in the USA pre/after-1990.
