이 연구는 3·1운동 과정에서 보이는 학생층의 역할과 그에 대한 일제의 행형을 실증적으로 추적한 것이다. 학생층은 3·1운동의 계획과 추진, 그리고 전파와 대중화의 전위적 역할을 수행하였다고 알려졌다. 하지만 구체적인 사례를 통해 학생층의 역할을 더 자세히 조명하고, 나아가 그 활동의 특징과 의의도 함께 추적해볼 필요가 있기 때문이다. 전국 각지에서 펼쳐진 학생층의 활동을 다 고찰할 수는 없다. 그래서 3·1운동으로 인해 서대문형무소에 투옥된 학생 수감자들을 중심으로 그들의 인적사항과 활동내용을 추적하면서, 그들이 수행한 주된 역할과 의의를 고찰하였다. 아울러 이들에 대한 일제의 행형 내용을 분석하여 그 특징을 살펴보고자 하였다. 서울은 3·1운동의 발원지이자 축소판으로 서대문형무소에 수감된 학생들이야말로 3·1운동의 계획과 추진, 그리고 전개과정에서 수행한 학생층의 온갖 역할을 함축하고 있기 때문이다. 서대문형무소에 투옥된 학생 수감자들의 역할은 3·1운동 주모자, 서울 만세시위운동 주동자, 지방 만세시위운동 주동자, 3·1운동 전파자, 3·1운동 기념 만세시위운동 주동자 등으로 구분된다. 대개 이들은 고등보통학교 학생과 전문학교 학생 이상의 고학력자들이며, 또 당시의 사정 때문이기도 하지만 나이가 학생으로는 많은 편이었다. 이들 학생 수감자들은 3·1운동의 발발과 전개 과정에서 보이는 다양한 역할과 활동을 수행하였다. 3·1운동의 계획 추진 단계부터 참여하면서 3·1운동을 발발시키고, 나아가 3·1 독립선언대회와 제2차 서울 학생 만세시위운동인 3월 5일 남대문역 만세시위 운동을 전개하여 3·1운동을 전국적으로 전파하는 선도적 역할을 수행한 것이다. 이어 서울에서 독립신문·경고문·격문·임시정부 선언문·노동회보 등 각종의 독립운동 관련 문건을 제작하여 살포하면서 각계각층의 만세시위운동을 이끌어내 3·1운동을 대중화하는 데도 앞장섰다. 더 나아가 서울의 만세시위운동 경험을 토대로 귀향하여 고향의 만세시위운동을 추진하여 펼쳐갔다. 각지의 봉기 계획을 짜고 독립선언서와 태극기, 그리고 격문 등을 제작하여 살포하면서 만세시위운동을 주도함으로써 3·1운동이 전국적이며 거족적인 독립운동으로 발전하는데 기여한 것이다. 뿐만 아니라 1920년 3월 1일 3·1운동 기념일을 맞이해서는 기념 만세시위운동을 전개하여 3·1정신을 되살리기도 하였다. 이들에게 적용된 법령은 크게 보안법과 출판법, 그리고 형법상의 소요죄 등이었다. 서대문형무소에 투옥된 학생 수감자 71명 가운데 68명이 보안법이 적용되었고, 또 보안법과 출판법이 병합 적용된 이른바 ‘병합죄’의 경우도 학생 수감자의 절반에 가까운 34명이나 되었다. 학생 수감자들에 대한 양형을 보면, 대개 서울과 지방 만세시위운동 주동자들로 보안법만 적용된 수감자가 33명인데, 이 가운데 징역 1년 이상의 중형자가 19명으로 절반이 훨씬 넘었다. 이에 비해 3·1운동 주모자로 보안법과 출판법이 병합 적용된 경우와 출판법만 적용된 수감자를 합한 숫자가 37명에 달했지만, 이 가운데 징역 1년 이상의 중형자는 16명으로 보안법만 적용된 경우보다 적었다. 이는 일제가 실제적인 만세시위운동 주동자와 활동가들을 더 가혹하게 처벌한 사실을 보여준다. 아울러 일제가 만세시위운동 주동자와 격렬 시위자들을 가급적이면 중형으로 처벌하여 3·1운동의 전국적인 전파와 확산을 막기에 전전긍긍했던 단면을 드러내는 것이다. 결국 일제는 최고형이 징역 2년인 보안법과 최고형이 징역 3년인 출판법으로는 요원의 불꽃처럼 번져나가는 3·1운동의 폭발력을 잠재울 수 없었다고 보았다. 그리하여 일제는 3·1운동이 고양되어 가던 4월 15일 최고형이 징역 10년인 소위 ‘대정8년 제령제7호’, 즉 ‘소요처벌령’을 발포하고 즉일 시행함으로써 만세시위운동에 대한 탄압을 강화하는 법적 장치를 마련하였던 것이다.
