A situation that the Korean Constitution adopts Prime Minister, not Vice-President, under President system has brought about the problem of the Acting Prime Minister. Acting system means that administrative agency vests the authority in stranger when a administrative officer is deceased and resigns for having the same legal force as agency acting. It is necessary to obtain the consent of the National Assembly for the position as a Acting Prime Minister, because the Korean Constitution Article 86 (1) said that ”The Prime Minister shall be appointed by the President with the consent of the National Assembly”, besides the Korean Constitution has not express provisions of Acting Prime Minister system. In the conclusion, Prime Minister should get the double confidence of the National Assembly that represents national opinions as legislative department and President that is directly granted the democratic justice from them as executive department.
