한미 FTA와 노동기준우리나라와 미국은 2007년 4월 2일 FTA를 체결하여 양국가의 의회의 비준절차를 남겨두고 있다. 우리나라가 체결한 FTA 가운데서 처음으로 노동의 장이 규정되었다. 본 논문은 FTA 노동의 장 중 제19.2조에 규정된 근로자의 노동기본권-① 결사의 자유, ② 단체교섭권의 효과적인 인정, ③ 모든 형태의 강제적 또는 강요에 의한 노동의 철폐, ④ 아동노동의 효과적인 폐지, 그리고 이 협정의 목적상 가혹한 형태의 아동노동의 금지, 그리고 ⑤ 고용 및 직업상의 차별의 철폐-에 관하여 중점적으로 살펴보고 이를 바탕으로 우리나라 노동기준의 개정방향을 제시하려는데 그 목적이 있다.


The Free Trade Agreement between the Republic of Korea and the United States of America(The KORUS FTA) was signed in Washington D.C. on 2 April. 2007. It was not yet ratified but it will be ratified sooner or later. This paper studies the KORUS FTA and labor standards. The KORUS FTA prescribes the core labor standards, as the so-called social clause stated in the WTO system. The KORUS FTA Article 19.2( FUNDAMENTAL LABOR RIGHTS) prescribes the following rights, as stated in the ILO Declaration on Fundamental Principles and Rights at Work and its Follow-Up (1998) (ILO Declaration): (a) freedom of association(ILO Convention No. 87); (b) the effective recognition of the right to collective bargaining(ILO Convention No. 98); (c) the elimination of all forms of compulsory or forced labor(ILO Convention No. 29 and No. 105); (d) the effective abolition of child labor and, for purposes of this Agreement, a prohibition on the worst forms of child labor(ILO Convention No. 138 and No. 182); and (e) the elimination of discrimination in respect of employment and occupation(ILO Convention No. 100 and No. 111). To conclude, This paper suggests that our nation should sooner or later ratify ILO Convention No. 87, No. 98, No. 29, No. 105 and our labor standards should be enhanced or amended in accordance with ILO Declaration on Fundamental Labor Rights in order to enforce the KORUS FTA.
