국제 무역에서 발명과 지식이 가지는 중요성은 더욱 부각되고 있으며, 지식재산의 보호 범위 역시 점차 확대되고 있다. 국가 경쟁력의 제고 방안으로 자리하게 된 지식재산권의 보호는 효율적인 국제 규제의 필요성을 부각시켰고 이에, WTO는 TRIPS협정을 통하여 지식재산의 보호와 집행에 관한 국제적인 기준을 마련하였다. TRIPS협정상의 지식재산권 보호 규정은 매우 포괄적이며 광범위하고 규정이 정하는 범위 내에서 보다 강화된 지식재산의 보호를 인정한다. 그러나 의약품과 관련된 엄격한 지식재산의 보호는 전 세계적인 공중보건의 위기를 불러일으키는 요소로 자리하기도 한다. 즉, 발명 물질이나 제조 과정의 지식재산 보호로 의약품 가격이 상승하게 됨에 따라 의약품접근권이 제한되는 경우가 발생하는 것이다. 국제적인 지식재산권의 보호 노력과 의약 기술 및 의약품에 대한 접근성을 확보하기 위한 노력 사이의 문제를해결하기 위한 방안이 꾸준히 논의되고 있다. 특히, FTA는 지식재산권의 보호 수준을 보다 향상시키기 위한 규정을 포함하는 경우가 많으며, 공중보건 보호의 문제 해결의 실마리를 제공하는 TRIPS협정상의 ‘융통성’을 한정하는규정을 포함하고 있어 관련 논의가 제기되고 있다. 본 논문은 이와 같은 규정이 의약품 구입 여력을 갖추지 못한국가의 의약품 접근성을 저해함으로써 공중보건의 위기를 초래하기도 한다는 점에 주목하고 있다. 의약품은 공공재적 성격을 가지는 만큼 향후 체결될 FTA에서 TRIPS협정의 ‘융통성’ 규정을 반영한다면 의약품 접근권을 둘러싼충돌을 조화롭게 해결할 수 있을 것으로 보인다.
The importance of intellectual property protection in modern international trade is ever-growing in WTO regime. In addition, the necessity of international regulation of intellectual property has been strengthened because of globalization of international market, emphasis of intellectual property as an important element of national wealth by states. Intellectual property protection is to promote creative motive by recognizing legal protection on intellectual creation. On the other hand, as increased level of intellectual property protection under the TRIPS Agreement had effects on drug prices, developing and least-developing countries became confronted with a chilling effect on access to life-saving pharmaceutical products. This has pushed the society into the critical state of threatening the public health. The TRIPS Agreement aimed to harmonize intellectual property enforcement and provided some exceptions to strict patent enforcement. In other words, TRIPS Agreement introduces some kind of flexibilities to allow the WTO members to adopt measures to protect public health and nutrition. When a person's life and an intellectual right collide, the intellectual right should be limites as a way of practicing the promotion of right to life. An economic profit should give away to a person's life because the later cannot be replace by another. Therefore WTO members realize the changing social attitudes and support the developing and least-developing countries's access to affordable medicines.
