2014년 정부의 조직개편안에 대해 국회에서는 정부의 개편안을 찬성하는 여당과 이를 수정하여 개편해야 한다는 야당간에 신경을 곤두세우고 있다. 정부의 조직개편안은 국가안전처를 신설하여 재난을 일원적으로 관리하고 대응능력을 강화하겠다고 한다. 본 고에서는 이에 대하여 문제점을 제시하고 대안을 제시하고자 한다. 첫째, 국가안전처 또는 국민안전부라고 하기 위해서는 국가안보적 차원의 개념과 재난으로부터의 안전차원의 개념이 들어가야 되는데, 국가안보적 차원의 조직편성이 되어 있지 않다. 야당안인 국민안전부도 거의 동일한 맥락을 가지고 있다. 둘째, 해양경찰의 역사에서 61년 중 54년 동안 사용해 온 고유명칭이다. 해양안전본부·해양안전청으로 그 고유명칭을 바꾸는 것은 정체성의 혼란을 야기하는 측면이 있다. 그 명칭도 다소 생소하게 “국가안전처 해양안전본부 소속의 경찰관”, “국민안전부 해양안전청 소속의 경찰관”이라고 해야 할 것이다. 이렇게 하기 보다는 해양경찰청을 그대로 두든지 해양경찰본부라고 명명하는 것이 합당할 것이다. 셋째, 정부안의 문제점은 정보·수사 기능의 경찰청 이관으로 인한 해상치안조직의 이원화이다. 일원화가 바람직하다. 미국은 지금부터 100년전인 1915년에 두 기관을 통합하여 U.S. Coast Guard를 창설하면서, 일본은 66년전인 1948년에 미국을 모델로 해상보안청을 설치하면서부터 해상치안이 일원화되었다. 우리나라는 조직보호본능과 조직이기주의에 의해 일원화된 해상치안이 이루어지지 않고 있다. 선진국의 사례에 역행하여 해상치안기능을 분리하려고 추진하고 있다. 정보·수사를 분리하는 것은 효율적인 법집행이라고 볼 수 없고, 새로운 비용을 발생할 가능성이 크다. 개편방향으로는 기존의 해양경찰청을 유지하고 구조기능을 강화하는 측면이 바람직할 것이다. 본청의 정보수사국을 유지하고 지방의 해양경찰서의 정보과와 수사과를 통합하여 정보수사과로 구성하고 남은 인력은 해양안전, 122구조 기능에 재배치하는 것이 더 합당할 것으로 판단된다.

The reorganization of the national government is usually influenced by the new president’s policy orientation, which is different from the previous president. This study finds problems of Korea Coast Guard’s reorganization plans in 2014, and proposes counterproposal. The study materials and interpretation include previous studies, governmental documents, and discussions with professors, researchers, government officials, and journalists. The problems of Korea Coast Guard’s reorganization plans in 2014 is as follows. First, to be ministry of national safety or people safety, ministry name have to include national security concept and disaster concept. But there is no national security concept in current reorganization plan. Second, in the 61 years history of Korea Coast Guard, name of maritime police was used during 54 years. to change ‘maritime police’ name as maritime safety is chaotic at true character of Korea Coast Guard. Third, jurisdiction transfer of intelligence and investigation functions to National Police Agency is to devide maritime policing organization. this reorganization plan go back world trend. Counterproposal direction of reorganization is to maintain to office of Korea Coast Guard, reinforce rescue function. Intelligence and investigation function of 15 police stations have to integrate to one division. Remained manpower from integration have to reorganize safety and 122 rescue function.
