경찰권 행사에 관한 법적 근거를 마련하는 경우에도 가급적 그 요건과 효과 및 한계가 명확하게 설정되는 개별적 수권조항 방식이 민주적 법치국가에 적합하다는 것에 대해서는 재언을 요하지 않는다. 그러나 오늘날 사회의 급속한 변화와 위험사회의 심화에 따라 입법자의 예측과 상상을 초월하는 각종 위험이 빈발하고 있어 이 모든 것을 개별적 수권방식으로만 해결하기는 입법기술상 불가능하다. 결국 일반적으로 경찰법규에 의하여 경찰작용을 수권하고 기속하는 경우에 입법기술상 복잡ㆍ다양하고 가변적인 사회 현실에 대하여 모든 경우를 예상하여 빈틈없이 일의적ㆍ확정적 개념으로 행정 행위의 요건을 정하는 것은 사실상 불가능하며, 경찰작용이 정치ㆍ경제ㆍ사회ㆍ기술 등 가변적인 사회 현실에 맞추어 경찰목적을 능률적으로 달성하기 위해서 경찰권 행사에 대하여 어느 정도 해석ㆍ판단의 여지를 인정할 필요가 있음을 고려할 때 경찰상 일반적 수권조항의 필요성에 대하여 일반적으로 인식은 같이 하고 있는 듯하다.따라서 본 논문에서는 우리나라 경찰법상 일반적 수권조항의 존재 여부에 대한 학설과 판례를 살펴보고 효과적인 경찰권 행사를 위한 일반적 수권조항의 입법 방향을 제시하고자 한다.

A study on the General Empowerment Clause in Korean Police Law For the prevention of hazard to the public peace and system, the police uses authoritative and violative action by the main measure. Nevertheless the duty of prevention belongs to the police, the police can not make use of the measure which leads to legal responsibility to a nation without legal bases. Therefore, the police authorities must be based on the related laws. It is legal conclusion by a law-governed country or a form of empowerment administration. The legal bases of the police authority actions have a form of empowerment based on the individual empowerment clauses and general empowerment clauses in the legal description. The way of the police authority actions concerning the individual empowerment clauses is distinguished into two types in the contents. One is the police authority actions based on the individual empowerment clauses of the general police laws, the other is the police authority actions based on the individual empowerment clauses of special police laws. There is no doubt about the consideration of the individual empowerment clauses in the police legislative system. In the police law of our country, it is under discussion whether the general empowerment clauses exist and the police authority actions can be used by the general individual clauses. Especially, it is a matter whether Article2 of the Police Officer Duty Performance Act, No.5 of that (the public peace and system) is the general empowerment clauses. With as the central figure, the purpose of this paper is to look around whether the police laws of our country exist concerning theories and judical precedents and direct the legislation direction of the general empowerment clauses for the effective police authority actions.
