21세기 들어와 지방자치에 대한 국민의 수요는 증가하고 있다. 특히 자치경찰에 대한 갈망은 그 어느 때보다 국민들 사이에서 강하게 대두되고 있다. 이에 부합하여 현 정부는 자치경찰법(안)에 의해 2006년 하반기에 일부 기초자치단체에 대하여 자치경찰을 실시한 후 2007년 7월부터 전면적으로 기초자치단체에 자치경찰을 실시할 계획을 가지고 있으며, 현재 국회통과를 기다리고 있다.이러한 자치경찰법(안)은 행정법의 기본이념인 민주화와 지방자치의 이념에 부합하는 것 같으나 실제 그 구체적인 내용을 보게 되면 여러 가지의 문제를 가지고 있다. 특히 실시지역을 기초지역으로 한정한 것과 선택적 실시, 폐지시 재설치의 제한, 자치경찰대장의 직급차등화, 기초자치단체장의 지휘명령하에 둔 것, 복장의 차별화 등 상당 수 자치경찰의 본연의 이념과 배치되는 내용을 가지고 있어 본 논문에서는 국회에 상정된 법(안)이 가지고 있는 구체적인 문제점을 지적하고 이에 대한 개선안을 제시하였다.본 연구는 향후 자치경찰의 시행에 부응하여 문제점을 제시함으로써 발생할 수 있는 사안을 이론적으로 고찰함으로 새로운 개선안을 마련할 수 있는 토대를 제공하는데 기여할 것이다.
