공동주택의 재건축 내지 재개발이 추진되는 경우는, 건축물이 훼손되거나 일부가 멸실되어 붕괴 또는 안전사고의 우려가 있거나 건축물의 기능적 결함, 부실시공 또는 노후화로 인한 구조적 결함 등으로 인하여 철거가 불가피한 경우에 한해 허용되고 있다.이와는 달리 공동주택의 리모델링은, 건축물의 훼손 또는 멸실 정도가 재건축을 추진해야 할 만큼 건물의 노후 또는 불량정도가 덜하며 건축물의 노후화 억제 내지 기능향상을 위하여 증축개축 또는 대수선 하는 행위를 말한다.이처럼 양 제도의 취지와 사업진행 과정이 근본적으로 상이함에도 불구하고, 재건축에 참여하지 않는 구분소유자에 대하여 일정한 절차에 따라 그 구분소유권의 매도를 청구할 수 있는 권리를 규정하고 있는「집합건물의 소유 및 관리에 관한 법률」제48조를, 주택법 제18조의2를 통해 공동주택의 리모델링사업에 그대로 준용하고 있는 것은 부당하다고 할 것이다.한편 리모델링사업에 있어, 매도청구권의 요건을 보면, 재건축에 있어 전체 구분소유자의 동의 5분의 4보다 훨씬 용이한 3분의 2의 동의를 요하는 현행 주택법의 규정은, 재건축의 경우보다 더욱 보호법익의 필요성이 큰 리모델링 불참자의 기본권을 과도하게 침해하는 위헌적인 규정이라고 하지 않을 수 없다.


The reconstruction or redevelopment of apartment houses is permitted when they need to be demolished for unavoidable circumstances, such as those instances where it is feared that the buildings may collapse or cause a threat to public safety owing to their deterioration or partial destruction, or where they have functional or structural defects attributable to defective construction or superannuation. However, the remodeling of apartment houses also refers to the extension, remodeling or extensive repair work carried out in order to prevent their further deterioration or to improve their functionality when the degree of their deterioration of wear does not justify their reconstruction. Therefore, the two systems - reconstruction and remodeling - have basically different purposes. Nonetheless, Article 48 of the Act on the Possession and Management of Apartment Buildings, which provides association members with the right to claim or request the sale of ownership of apartment blocks or units belonging to those who do not partake in the reconstruction association pursuant to a given procedure, is mutatis mutandis applied to remodeling under Article 18-2 of the Housing Act. However, the Act on the Possession and Management of Apartment Buildings stipulates the prerequisite that agreement must be reached by four fifths of the totality of the unit owners for such claims for sale, whereas the current Housing Act provides for only two thirds, which is much easier to arrange. It is an unconstitutional provision that excessively damages the basic rights of those who do not partake in a remodeling association as their protection has a legal benefit greater than that of those who partake in a reconstruction association.
