부동산이 지니는 고정성 내지 개별성이라는 특수성은 부동산 시장을 추상화시킴으로서, 부동산의 거래에 있어서는 다른 재화와는 달리 부동산시장의 정보를 잘 알고 있는 전문직업인인 중개업자의 조력을 대부분 필요로 하게 된다. 이러한 중개업자의 역할을 법적으로 근거지우는 것이 바로 부동산중개계약이다. 현행 공인중개사의 업무 및 부동산 거래신고에 관한 법률 제22조에서는 “중개의뢰인은 중개의뢰내용을 명확하게 하기 위하여 필요한 경우 중개업자에게 …… 기재한 중개계약서의 작성을 요청할 수 있다.”는 일반중개계약에 관한 규정을, 같은 법 제23조에서는 “중개의뢰인은 중개대상물의 중개를 의뢰함에 있어서 특정한 중개업자를 정하여 그 중개업자에 한하여 당해 중개대상물을 중개하도록 하는 계약을 체결할 수 있다.”는 전속중개계약에 관한 규정을 각각 두고 있다. 그러나 실무에서는 법 제22조와 제23조의 규정은 활용되고 있지 않을 뿐만 아니라, 중개업자와 중개의뢰인간의 법률관계가 명확하지 못하여 부동산 중개사고가 빈번하게 발생하는 것이 부동산중개업계의 현실이다. 이 논문에서는 부동산중개계약의 개념, 법률적 성질 및 유형별 특성에 대해 검토함으로써 중개계약제도의 개선방향을 제시하고 있다.

Therefore, in a real estate transaction, one requires assistance from an expert, that is, a listing activity by a real estate agent to lead transaction to success. The purpose of this thesis study is to contribute the protection of citizens property and secure the developing dealing order through the developing method offering by grasp of the problems on the contraction system between the brokers and reliances. This paper consists of 5 chapters. Chapter 1 is introduction and chapter 2 is about concept of real estate listing contract, including the history of real estate listing contract. Chapter 3 types of real estate listing contract and chapter 4 will suggest how to improve real estate listing contract, the subject of the paper. Chapter 5 will summarize what has been discussed in the paper. Finally, this study hope to help the development of the real estate listing contract in Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act.
