국민의 복지를 위하여 국가는 적극적인 기능을 수행하는데 종래의 전형적인 행정수단으로는 부족하여 이에 여러 가지 행정수단이 고려되어, 이 중 하나로 발전한 것이 행정지도이다. 행정지도는 과학기술, 경제활동처럼 법에 의하여 오히려 탄력성을 해치는 경우와 같이 법령에 의한 규제가 친숙하지 않는 경우라도, 행정임무는 행정목적에 비추어 대응하여야할 필요가 있는 경우에 유용하다. 이와 같은 행정지도는 법치행정부문에 있어 논란이 있고, 행정지도 행사에 따른 행정행위의 위법·부당·권리남용의 가능성이 있어 이로부터 국민의 권리보호를 위하여 행정지도의 법적 근거와 한계를 명백히 할 필요가 있다.본 논문은 행정지도의 역할확대에 따라 논란이 되고 있는 행정지도의 법적성질, 근거, 한계를 고찰하고 행정지도의 문제점을 제기하여, 그 개선방안을 제시하고자 한다.
