개인의료정보는 의료인들이 환자에 대한 치료행위를 통하여 수집된 자료들과 이 자료들을 기초로 하여 연구분석된 정보들을 포함하는 것으로서 환자와 의료진들로부터 수집되는 모든 정보의 총체라고 할 수 있다.이러한 의료정보는 임상의료 및 의학연구와 공익을 위해서 필수적인 자료로서의 역할을 하고 있으며, 의학은 이와 같이 수많은 환자에 대한 의료정보의 축적으로 이루어진 학문이다. 의료정보는 많은 사적인 정보를 포함하고 있기 때문에 이에 대한 보호가 충분하지 않을 경우 개인 사생활의 비밀에 대한 프라이버시 침해라는 문제를 야기할 수 있다.이 논문은 의료정보의 침해에 의해서 야기되는 민사법적 문제점에 초점을 맞추어 이에 대한 민법에서의 해결책을 제시해보고자 한다.
