골프장 이용 약관은 골프장사업자와 골프장의 시설물을 이용하려는 모든 내장객간의 골프장 시설물 이용 및 이에 따르는 책임에 관한 사항을 규정함을 목적으로 작성된다. 하지만 대부분의 국내 골프장사업자는 공정거래위원회가 작성한 표준약관이 있음에도 불구하고 사업자로서의 우월한 지위를 이용하여 자신들에게 유리한 약관을 채택하여 부당하게 골프클럽을 운영하고 있는 게 우리의 현실이다. 그 중에서도 특히 회원의 탈회시 입회금 반환에 있어, 회사의 사정상 즉시 지급이 불가능한 경우에는 일정기간 반환을 연장할 수 있도록 한 조항과, 기존의 회칙을 회원동의 없이 임의로 변경하여 회원에게 강요하는 것은 약관규제법에 위반되어 그 효력이 없다고 할 것이다. 또한 골프인구에 비해 턱없이 부족한 우리의 골프장 현실을 감안한다고 해도 골프장사업자의 일방적이고 독단적인 부킹시스템과 관련 법률의 규정 때문에 명목상 운영되는 허울뿐인 운영위원회의 행태는 회의록의 공개와 같은 실질적인 운영이 될 수 있도록 관련 법률을 개정해서라도 바로잡아야 할 것이다. 골프가 더 이상 일부 특권층의 전유물이 아닌 대중 스포츠로 자리 잡은 현실을 감안할 때, 후진적 운영을 면치 못함으로써 해외로 빠져 나가는 골퍼들의 발길을 돌리기 위해서라도 하루빨리 표준약관을 채택하지 않고 있는 골프장 사업자에게는 강한 행정제재가 가해져야 할 것이다.

The terms and conditions of golf membership are prepared in order to stipulate the terms and conditions in using the golf course facilities and accompanying responsibilities between those who want to use the facilities in the golf course and the golf course owners. However, most golf course owners in Korea have been unreasonably operating the golf courses by adopting the terms and conditions favorable to them using their superior positions as the owners although there are standard terms and conditions stipulated by the Fair Trade Commission. Among the unfair terms and conditions, the provisions allowing a golf course owner to extend the term of return to some extent if the golf course owner can’t immediately return the enrollment fee due to a certain reason when a member wants to give up a membership and the provisions that a golf course owner changes a certain provision at its will and forces the members to accept them infringe the Regulation of Standardized Contracts Act and so will not have any effects. Although we admit that the golf courses are not really enough for the number of those who enjoy golf in Korea, we should correct the behaviors of steering committee in the name only as it works only because of the regulations related to unilateral and arbitrary booking system of golf course owner for the practical operation including the disclosure of proceedings, for example, by revising the regulations. In consideration of the fact that the golf is not only for some privileged classes any more but becomes the public sport, the strict administrative sanctions should be inflicted to the golf course owners who don’t adopt the standard terms and conditions as soon as possible in order to attract the golfers going abroad because of the underdeveloped operation of golf courses.
