본 논문은 2007년에 제정된 중국 물권법과 2008년에 17기 3중전회의 결정을 중심으로 최근 부동산용익물권제도의 변화된 모습과 그 특징적인 내용을 살펴본 후 북한 민법의 부동산용익물권과 앞으로의 변모가능성 및 중국법의 계수 가능성 등을 모색하고 있다. 중국의 부동산용익권은 토지의 사회주의공유제에 기초해서 토지에 대한 국가와 집단소유만을 인정하고 개인에게는 소유권과 분리된 권리로서 사용권을 인정하는 것이 근간이다. 그런데 그 후 각종 법의 제정 또는 개정을 통하여 개인에게 주택은 물론 토지에 대한 독립한 사용권과 그 양도를 인정하고 더 나아가 도시뿐만 아니라 농촌에서도 토지사용권의 유상양도를 인정하는 방향으로 변모해왔다. 이러한 중국의 부동산용익권의 변모는 북한이 종래 합영법 등 경제개혁․대외개방관련 입법에서 중국의 관련법의 영향을 받아 왔다는 점에서, 앞으로 북한이 중국의 경제제도를 모방하여 간다면 중국의 부동산용익권 관련 입법에서 북한이 계수할 주요 입법에 대한 추측 및 이에 대한 연구의 자료로 삼을 수 있을 것으로 판단된다.
