‘민간경비’는 ‘공경비’의 대칭개념으로 사용되어지며 민간기구 또는 기관에 의해 범죄예방 역할을 하는 것을 말한다. 즉, 민간경비는 특정의뢰인으로부터 보수를 받고 그에 상응한 범죄예방 차원의 경비서비스를 제공하는 것을 말한다. 이러한 민간경비는 경비업법과 청원경찰법에 근거를 두고 있으며, 경비업법은 시설경비, 호송경비, 신변보호, 기계경비, 특수경비 등으로 업무의 세분화가 이루어지고 있다. 반면, 청원경찰은 청원경찰법에 근거하여 경비 및 위해방지 역할을 하고 있다. 청원경찰과 특수경비는 일반경비에 비해 국가의 중요시설에 대한 경비와 방호를 전담하며 범죄예방 및 진압역할을 한다. 특수경비의 경우 향후 청원경찰을 대체할 목적으로 2001년 제정되었으나 현재까지는 청원경찰과 이원적으로 운용되고 있다. 청원경찰이 점차 감소하는 추세에 있기는 하지만 청원경찰의 신분이 법적으로 보장받고 있는 한 자연적인 감소에 의한 청원경찰의 폐지는 오랜 시간이 걸릴 것으로 보인다. 반면, 특수경비원 제도가 활성화 되면서 그 영역도 넓혀가고 있지만 특수경비원의 활동이 청원경찰에 비해 법적인 보장 장치가 미흡하여 정당한 경비활동이 위축될 우려도 있다. 따라서 국가중요시설의 경비라고 하는 동일한 목적을 가지고 이원적으로 운영되고 있는 청원경찰법과 특수경비제도를 통합이나 조정 또는 일원화함으로서 효율적이고 능률적인 경비업무가 이루어질 수 있어야 한다.
Police detailed system has been established since 1973 as a complementary national police system in Korea. The main object of Police detailed is the prevention of crime and protection for the essential establishments of the nation such as the administrative machinery buildings, the embassy in Korea, Air-port, harbor facilities, generating plants, banking facilities and the public institutions etc. The other side, Special Security guards system took charge of its defence on the same purpose of the police detailed system since 2001. Special Security agent has especially an object to protect the international air-port, harbor, nuclear energy plants and also essential establishments of the nation. However, they, Police detailed agent and Special Security agent, don't have the same legal authority on their field activity even though they have the same goal to protect national essential establishments. A comparative study on the Law of Police detailed and Special Security system research on both system for the sake of settlement or integration. Because they have the same goal and even the role, also it needs simplification rules for the private security development. On that account this paper research and analyze the problems and remedy about the Law of Police detailed and Special Security system for the prevention of crime and the settlement private security system.
