이 논문은 제주지역에 있어서의 재산상속에 관한 관습 및 재산상속관련 분쟁의 해결 관행, 그리고 재산상속에 관한 법의식에 관하여 설문조사를 실시하고 이의 분석을 통하여 그 내용과 제주도적 특색을 분석․검토하고 있다. 설문조사 내용은 영역별로 크게 ① 재산상속 관습실태, ② 재산상속 관련 분쟁해결 관행, ③ 재산상속 관련 법의식 등 3개영역으로 나누어 총 25문항으로 이루어지고 있다. 표본의 추출은 다단계층화집락표집법에 의존하였는데, 제주특별자치도를 제주시와 서귀포시로 나눈 후, 이를 다시 읍․면․동지역으로 세분화 하여 추출한 후 표본을 할당하고 있다. 설문조사결과를 분석함에 있어서, 위의 선행연구들을 바탕으로 비교할 수 있는 항목에 대해서는 선행연구와 비교하여 분석하고 있는데, 몇가지 문제에 대해서는 선행연구와 큰 차이를 보이고 있는 것으로 분석되고 있다. 이 분석결과는 오늘날 제주지역의 재산상속의 관습을 연구하는데 큰 도움을 줄 수 있을 것이며, 재산상속과 관련된 재판에 있어서 이상적이고 합리적인 방향을 모색하는데 어느 정도 시사를 줄 것이다.
This paper reviews the information and analysis has been featured Jeju-Island on inheritance customs that the resolution of disputes related to inheritance and practices, and on the legal consciousness of inheritance about the survey through an analysis. For the survey area, largely by ① Status of inheritance customs, ② dispute resolution and practices related to inheritance, ③ legal consciousness regarding inheritance, etc. divided into three parts could be achieved by a total of 25 questions. Extraction of samples in a multi-layer colonies sampling method relied, Jeju City and Seogwipo City, Jeju Special self-Governing Province, divided by the then, this town again. and rural subdivided after extracting the sample has been allocated. In analyzing the survey results in, based on these previous studies could be compared against analysis and by comparison with previous studies, which for some problems the big difference with previous studies showing that have been analyzed. The results of this analysis, today about inheritance customs of Jeju-Island to study will be a big help, in the trial relating to inheritance more rational way and try to find will give a little current events.
