컴퓨터가 사회생활의 모든 영역에서 사용되기 시작하면서 그 영향은 증대되어 가고 있고 컴퓨터 등 자동화 장비가 통신망과 결합되어 하나의 네트워크를 형성하고 그러한 네트워크를 이용하여 법적으로 의미있는 행위가 일어나고 있다. 이러한 인터넷 등 자동화장비를 사용하여 이루어지는 법률행위는 우리의 민법이론의 제시하고 있는 법현실과는 상당히 차이를 보이게 된다. 이와 관련하여 당사자의 의사표시가 컴퓨터를 이용하여 전자식으로 표시된 경우에 이들 의사표시를 자연적 의사표시와 달리 보아야 할 것인가 문제된다. 그리고 정보통신기술의 발달에 따라 인공지능의 응용 등으로 사람의 구체적인 의사를 전달하는 역할에서 점차 독립적으로 의사표시를 행하는 역할로 그 영역이 확대되고 있어 현행 민법의 단순한 규정만으로 현대사회의 급속한 발전을 충분히 규율할 수 있는가라는 의문도 제기되는 데 이러한 인식하에 전자적 의사표시도입 긍정설과 부정설에 대한 비교, 전자적 의사표시와 자연적 의사표시와의 비교, 전자적의사표시의 효력발생시점과 격지자간의 의사표시 여부, 비정상적인 전자적 의사표시의 민법상의 법적문제 등을 살펴 향후 급증하는 전자상거래에서 민법상의 발생되는 문제해결에 뒷받침을 하고자 하는데 이 연구의 의의가 있다.
As the computer is used in every aspect of today’s life, its power to influence the modern society is ever increasing. One of the impacts the computer has brought to our life is establishment of a novel way people communicate, that is, online network. Just as with the traditional exchange of communications in the real world, acts and communications taking place in the online network may convey legal significance. However, due to their unique nature separated from traditional legal approach, online legal acts conducted by means of the Internet connection or any other automatic devices do not squarely fit the conceptual framework established by civil law theories in Korea. For example, if a person has expressed his or her intent electronically, should it be considered and treated differently than has been expressed otherwise? Moreover, a broader question should be whether the existing simple provisions of civil laws can regulate the increasingly sophisticated legal aspects of the modern society, as the sphere of concern is being expanded from conveying a person’s specific intent to expressing intent independently in keeping with development of communication technology and utilization of artificial intelligence. This study addresses these points with the aim of suggesting a solution to prospective issues to be involved in electronic commerce. Specifically, discussions will cover topics including: pros and cons of recognizing electronic expression of intent; comparison between electronic expression of intent and natural expression of intent; the point of time an electronic expression of intent takes effect and recognition of expression of intent between remotely located parties; and legal implications of irregular electronic expression of intent in the civil law context.
