우리나라 정부조직법상 조직개편의 문제점으로 제기되고 있는 사항들은 그동안 잦은 정부조직 개편, 정부조직 개편에 대한 비전문성, 비효율성, 비합리성, 그리고 공직사회의 불안정 등이 지적되어 왔다. 이와 관련하여 향후 우리나라 정부조직법상 조직개편에 있어서 개선방안으로 제시될 수 있는 사항은 조직개편의 법정주의, 입법절차의 준수, 조직개편의 전문성, 합리성, 정보기술의 활용 등이 제시될 수 있다. 첫째, 정부조직개편에 있어서 법치주의가 준수되어야 한다. 행정조직법정주의의 근본취지에 따라, 행정조직의 구성에 있어서 요구되는 법률유보의 원리는 정부조직개편에 있어서도 당연히 적용된다. 그것은 행정조직의 예측가능성, 법적안정성 및 민주적 통제를 확보할 수 있다는 점에서 장점이 있기 때문이다. 그리고 조직개편은 민주주의 원리에 따라 국민주권주의를 실현하기 위해서는 국민의 참여와 통제가 필요하다. 둘째, 정부조직개편에 대한 입법절차가 준수되어야 한다. 정부조직개편은 국가행정기관의 설치ㆍ조직 그리고 공무원제도를 합리적인 운영방식으로 선택하는 과정이라고 할 수 있다. 즉 정부조직개편에 있어서는 합리적인 절차를 마련하고 이를 준수하도록 함으로써 정당성원칙, 명확성원칙 등의 절차의 합리화가 필요하다. 셋째, 정부조직개편에 있어서 전문성을 기해야 한다. 정부조직의 관리측면에 있어 환경변화에 대응할 수 있는 공직구조의 능력을 제고하기 위해서 행정부서운영체제의 전문성과 창의력을 발휘할 수 있도록 문제해결능력, 프로젝트 운영능력 등을 겸비한 인재들이 구성되어야 할 것이다. 넷째, 정부조직개편에 있어서 합리성을 유지해야 한다. 정부조직개편에 있어서는 우선적으로 정부조직 자체에 대한 정확한 진단을 실시하여야 한다. 즉 행정기관에 대한 어떤 문제점과 사회 일반의 요구 내지 기대로써, 국민 또는 주민의 권익과 관련된 행정수요를 분석해야 한다. 그리고 유사ㆍ중복기구의 구조조정도 필요하다. 또한 국민의 서비스 욕구에 따른 고객 만족도를 향상시키도록 해야 한다. 아울러, 정부, 공무원, 사회단체, 언론, 시민단체, 지방정부 및 기업 등의 파트너쉽을 형성하는 것이 바람직하다. 다섯째, 정부조직개편에 있어서 정보기술을 활용해야 한다. 조직개편에 있어서 국민들은 많은 정보를 가짐으로써 올바른 정치적 의사를 형성하여 의견진술과 여론형성을 통하여 조직개편에의 참여를 확보한다. 정보공개는 국민의 신뢰성을 확보하기 위해서도 필요하다. 여섯째, 공무원의 신분이 보장되어야 한다. 정부조직 개편으로 인하여 공무원의 신분상의 권익이 침해받지 않도록 하기 위하여, ① 공무원을 정치적 압력으로부터 보호함으로써 주어진 책무를 수행할 수 있도록 한다. ② 근무상의 계속성을 확보함으로써 행정의 일관성과 능률성을 확보한다. ③ 행정의 전문성을 확보하여 행정서비스의 질을 높인다. ④ 공무원의 사기를 높여 국민에 대한 봉사의 질을 높인다.

And people’s participation and control is needed to reorganization to realize the sovereignty of people according to the principle of democracy. Second. Legislative process for the reorganization of government organizations should be followed. The reorganization of government organizations is the process of selecting the reasonable operating of civil service system. Furthermore, that affects to the national administrative institution’s establishment and organization. In other words, the rationality of the procedure Such as legitimacy and clarity is demanded through securing reasonable process to the reorganization of government organization and applying with that. Third. Professionalism of reorganization of government organization is needed. At the management side of the government organization, to enhance the ability of office structure that can respond to changes in the environment, organization need to be configured with talented people who have problem solving skills and project running skills in order that public administrative departments operating system can demonstrate professionalism and creativity. Fourth. In the restructuring of government organization, the reasonableness should be maintained. For the reorganization of the government organization, preferentially, the accurate diagnosis of the government organization itself should be implemented. In other words, the administrative demands associated with the interests of the residents or nation need to be analyzed. And the structure adjusting of similar and duplicated organization is needed. Furthermore, customer satisfaction according to the service needs of the people should be improved. In addition, the government, government officials, community organizations, the media, civil society organizations, local governments and businesses partnership is desirable. Fifth. The advantage of information technology should be utilized in the reorganization of the government organization. People can make political opinion properly through having a lot of information and can secure the participation in reorganization via statement of opinion and formation of public opinion. And disclosure of information is needed to secure people’s reliability. Sixth. The status of public officials must be guaranteed. To avoid infringing the rights of the public officer due to the reorganization of government organizations, protect the civil servants from the political pressure, to be able to perform their responsibilities given. Secure the consistency and efficiency of the administration by securing the continuity of working. Enhance the quality of the public administration by securing the professionalism of the public administration. Make better the quality of volunteering for the people by enhancing the morale of public officer.
