유엔 국제법위원회(ILC)는 2006년 제58차 회기에서 실무그룹의 권고에 따라 장기 작업계획의 주제로 “외국의 형사관할권으로부터의 국가공무원의 면제”로 결정하였다. 이후 ILC는 2007년 제59차 회기에서 자신의 작업계획에 동 주제를 포함하기로 결정하고 동 주제에 대한 특별보고자(Special Rapporteur)를 임명하였다. ILC는 제60차 회기 중인 2008년 7월 22일~25일, 29~30일에 있었던 2982~2987번째 회의에서 논의를 시작하여 동 주제에 관한 특별보고자의 예비보고서를 검토하였다. ILC는 2009년 제61차 회기와 2010년 제62차 회기에서는 동 주제를 심의하지 않았다. 2011년 제63차 회기에서는 특별보고자가 제출한 2차 보고서와 3차 보고서를 동시에 검토하였다. 그리고 2012년 제64차 회기에서는 특별보고자의 예비보고서에서 제기하였던 주요 쟁점에 대하여 재검토를 진행하였다. 동 회기에서는 면제에 관한 실체적 내용을 논의하였고, 또한 면제의 절차적 측면에 관하여도 논의하였다. 본 논문은 위와 같이 ILC가 최근에 새로운 의제로 선정하여 현재 작업 중에 있는 “외국의 형사관할권으로부터의 국가공무원의 면제”와 관련하여, 주요한 쟁점을 중심으로 현재까지 작업(논의) 현황을 소개·분석하고, 동 주제와 관련한 논의 방향을 제시함과 동시에 주요한 쟁점을 분석하여 동 주제와 관련한 국제법의 발전을 전망해 보고자 한다.
At its fifty-eighth session, in 2006, the International Law Commission(ILC), on the basis of the recommendation of a Working Group on the long-term programme of work, identified the topic “Immunity of State officials from foreign criminal jurisdiction” for inclusion in its long-term programme of work. At its fifty-ninth session, in 2007, ILC decided to include the topic in its programme of work and to appoint Mr. Roman A. Kolodkin as Special Rapporteur for the topic. At the sixtieth session, in 2008, ILC had before it the preliminary report of the Special Rapporteur on the topic. The Commission held a debate on the basis of the preliminary report of the Special Rapporteur. ILC did not consider the topic at the sixty-first session, in 2009, and at its sixty-second session, in 2010. At the sixty-third session in 2011, ILC considered the second and third reports of the Special Rapporteur. At the sixty-fourth session in 2012, ILC addressed the issues to be considered during the present quinquennium. The debate revolved around, inter alia, the methodological and substantive issues highlighted by the Special Rapporteur in the preliminary report. This paper analyzes considerations on the Immunity of State officials from foreign criminal jurisdiction and introduce the outlook for the major issues on topic.
