이 작품은 갈등하는 인간과 그들의 마음의 문제들을 매개로 보편적인 진리를 탐구하고 있다. 문학과 법은 개인의 인권보장과 시민사회의 법치주의를 확대할 수 있다. 그런 의미에서 이 작품 속에도 법적 함의가 있다. 본문 속에는 “이제는 그녀가 전혀 외출하지 않는다”, 그녀의 집에는 8년인가 10년인가 전부터 어느 방문객도 통과한 적이 없다고 한다. 철저하게 사회와 유리되고 단절되었다. 사회로부터 단절된 에밀리가 공동체가 부과하는 의무를 부담하여야 하는지도 궁금하다. 에밀리의 삶은 비극적이고 상징적 의미를 가지고 있다. 아버지 때문이기도 하다. 다른 이유는 남부의 구시대를 대표하는 그녀가 세월의 흐름에 따른 변화를 인정하지 못하고 그 변화에 적응하기를 거부한 것이다. 그러나 법적으로 중요한 것은 그녀 자신 스스로 자율적 존재가 아니였다. 아버지에게 철저하게 종속되어 있었다. 헌법이 말하는 인간존엄의 핵심인 ‘자율성’을 어디에서 어떻게 찾아야 하는가. 아울러 사회적 동물이라고 하는 인간이 사회로부터 철저히 단절되었을 때, 마지막 남은 그 연결고리를 이어가기 위하여 어떤 행동(에밀리가 배런을 살해한 행위)을 하였다면 그러한 행위의 헌법적 의미는 무엇인가. 헌법은 개인의 사상과 신조를 - 그것이 비록 사회의 윤리와 도덕에 반한다 할 지라도 - 보호한다. 남부처녀의 자존심을 지켜려는 에밀리의 양심은 분명 헌법적 함의가 있다. 에밀리의 유일한 사회와의 연결고리는 Barren과의 관계였다. Barren이 그녀를 떠나겠다고 선언하였다면, 그녀는 Barren만을 아니 남부 귀족의 자녀로서의 자존심만을 잃어버린 것이 아니라 - 세상 전체를 잃어버리게 된다. 사회와 단절하고 시체와 더불어 40년 동안 살아온 것도 그녀에게는 스스로 속죄의 생활이었을 것이고, 그녀의 양심이었을지도 모른다.
The work has handled universal truth with the human beings and their minds. Literature and law could enlarge and strengthen individual human right and rule of law(constitutionalism). There are sayings like "he never go out", "nobody has visited her from 8 years or 10" in the text. She was isolated from the community. If so, she was charged for the tax which the community has imposed on her? The life of Emily has the meaning of "tragic and symbolic". One reason is originated from her father, the other is from it that she as a representative for the 'south' didn't accept the change happened with the time and refuse to adjust herself to it. But she was not autonomous at all in her life. She was subordinated to her father. Nothing was found in her life that was to be called human dignity. It is said "Man is a social animal, and we cannot live alone". If her last link with the outside world would vanish, what kind of actions will she take for keeping the link. The killing of Homer Barren could be understand as one of them. And what is the constitutional meaning of the action. The constitutional law guarantees the action as long as from the individual right of conscience. Even if it is not ethical or not moral, the right protect the action from Emily's conscience. It is certain that the action in keeping of her pride as a maid from 'the south' has implication of 'the constitutional'. When his parting from her was informed, she might feel the world disappeared from her. Her live together with the corpse of Barren for 40 years long could be a kind of making atonement for her 'wrong'.
