기업이 그 활동으로 인하여 인명재해를 초래한 경우 엄격한 책임을 물을 수 있는 제도적 장치가필요하다. 이는 기업에 고용되어 일하는 근로자들의 산업재해로 인한 사망 뿐 아니라 기업의 고객과기타 관련된 사람들이 피해자가 된 경우에도 역시 문제된다. 근래 영국을 비롯한 각국에서는 소위 기업살인법(Corporate Manslaughter Act)을 제정하여 이러한 문제에 대처하고 있다. 국내에서도 기업이대규모 인명 피해를 야기한 경우 노동환경의 개선과 재난의 예방 및 안전사회의 구축의 관점에서 기업살인법을 제정하여 규제를 해야 한다는 주장이 제기되고 있다. 기업살인법은 법리적 측면에서 법인이 범죄능력을 갖는가의 문제, 기존의 안전관련 법률과의 중복의 문제 등 다수의 비판점이 있다. 규제완화의 관점에서 보면 기업살인법은 기업에 대한 또 하나의규제를 만들어내어 기업활동을 위축시킨다는 지적도 가능하다. 그러나, 일부 문제점에도 불구하고 현재 우리 사회에서 기업살인법의 입법은 필요성이 더 큰 것으로 판단된다. 특히 기업살인법이 단순히기업에 대한 처벌강화를 목적으로 한 것이 아니라, 인명재해에 대한 기업의 인식을 제고하고 기업문화를 일신시켜 사망재해를 예방하고 안전한 사회를 구축하는 것을 목적으로 한다면 현대의 위험사회에서 필요한 입법이다. 기업살인법은 기업에 대한 또 하나의 규제를 만들어 내는 것이라는 지적도 있다. 하지만, 다수의인명피해를 야기하는 사망재해를 막기 위한 안전에 관한 규제는 필요한 것이며, 기업살인법은 이 점에서도 필요한 규제의 하나라 할 수 있다. 다만, 기업살인법이 입법된다 하더라도 우리의 기업문화와사회문화의 현실을 반영하여 안전한 사회와 안전한 산업현장의 구축이라는 목적을 가장 효과적으로달성할 수 있는 내용을 담아내야 할 것이다.

In Anglo-American law, a corporation is a legal person and has a capacity ofcommitting a criminal offense. Thus, a corporation can be convicted of and sentenced fora criminal offence. However, some theoretical difficulties lie in fixing a corporation with theappropriate mens rea. The Corporate Manslaughter and Corporate Homicide Act 2007 isdesigned to solve those difficulties and punish a corporation like a natural person. Beforethe Act, a corporation could only be convicted of manslaughter if a employee of acompany committed a certain offences and was of sufficient seniority to be seen asembodying the controlling mind of the corporation. As a result such convictions were rare,and there was public discontent where it was perceived that culpable corporations hadescaped punishment. Comparing to Anglo-American law, a corporation is difficult to punish in Korean lawbecause it is well recognized that only natural persons are capable of committing a crime. However, concerns for safety in society and workplace is earning great attention in Korea,and increasing emphasis is being placed on responsibilities of corporations. This articlediscusses the need for legislation to adopt a corporate manslaughter act in Korea. Theauthor of this article concludes that a corporate manslaughter act is needed for the safetyof society and workplace in Korea.
