부동산은 일반 상품과 다른 특성으로 인하여 부동산의 취득 및 이용에 정부의 개입이 불가피하게 됨에 따라 부동산의 취득 및 이용에 관할관청의 인허가 등을 요구하는 부동산 거래규제의 법률들이 존재할 수밖에 없다. 이와 같은 경우에는 사립학교법상 사립대학이 소유하고 있는 부동산을 매매나 담보를 설정하기 위해서 교육부장관의 허가를 받도록 하는 경우, 전통사찰의 보존 및 지원에 관한 법률상 전통사찰로 등록되어 있는 사찰을 처분하고자 할 때 문화체육부장관의 승인을 얻도록 하는 경우, 향교재산법상 향교재산을 처분하거나 담보를 제공하려고 할 때 주무부장관의 허가를 받도록 하는 경우, 국토의 계획 및 이용에 관한 법률상 토지거래허가구역 내에서 부동산거래계약을 체결한 때에는 관할청장의 허가를 받도록 하는 경우, 농지법상 농지를 취득하려는 자는 농지소재지를 관할하는 시 . 구 . 읍 . 면장의 농지취득자격증명을 받도록 하는 경우, 부동산등기특별조치법상 부동산거래계약을 체결하는 때에는 부동산 소재지를 관할하는 시장 . 군수의 검인을 받아 관할등기소에 소유권이전등기를 신청하도록 하는 경우 등과 같이 부동산거래규제의 입법들이 있다. 따라서 이러한 규제 법률에 대한 규제개혁을 위해서는 정부뿐만 아니라 국회의원들의 의정활동이 무엇보다도 더 중요하게 작용하고 입법자는 가장 합목적이라고 생각하는 방법을 선택하여 의정활동을 통하여 적극으로 입법하여야 한다. 그러므로 정부와 더불어 국회는 국가경제의 활성화와 서민 경제생활을 보호하기 위해서라도 규제의 법률에 대한 개혁 작업에 적극적으로 나서야 한다.

As real estate has different properties compared to regular products and governmentintervention is inevitable for its acquisition and use, there have to be laws and regulations for real estate transaction restrictions that require authorization and permission of local government offices when acquiring and using real estate. Some of the legislations for real estate transaction restrictions include requiring thepermission of the Minister of Ministry of Education to sell or to set as security the real estate property owned by private colleges under the Private School Act, the permission of the Minister of Ministry of Culture and Sports to dispose of a temple that is registered as a traditional temple under the Act on Preservation and Support of Traditional Temples, the permission of the minister of responsible ministry to dispose of or to set as security the properties of a village school under the Village School Property Act, the permission of local governor when real estate transfer agreement has been signed within the zone where land transaction is permitted under the Act on National Territory Planning and Use, the certificate of qualification to acquire farms from the local governor to acquire farms under the Farmland Act, and the application for the registration of ownership transfer with the verification of local mayor or governor when signing a real estate transfer agreement under the Special Real Estate Registration Act. In order to reform these restrictions, the administrative activities of the government and the National Assembly members are more important than anything and the legislators should select the method that is most valid for active legislation. Therefore, the government and the National Assembly should make active efforts to reform the restrictive laws and regulations for national economy and the economic activities of citizens.
