우리나라 긴급자동차 제도가 본래의 취지에 맞지 않게 운영되지 않고 있어서 긴급구호에 문제가 발생하고 있으며, 무늬만 긴급자동차일 뿐 긴급업무에 즉응할 수 있는 체계가 갖추어져 있지 않아서 위험에 빠진 귀중한 생명을 신속하고도 효율적으로 구제하지 못하고 있다는 것인데 그 원인 중의 하나로 도로교통법이나 소방법과 같은 관계법령이 긴급자동차의 긴급출동을 보장해 주지 못하고 있다는 점이 지적되고 있다. 따라서 본 논문에서는 현제도의 문제점을 도출하고 그 개선하기 위한 제언을 하고자한다. 첫 번째 제언은 현행도로교통법에서 특례조항을 추가로 신설할 필요성이 있다. 그 신설할 내용은 통행의 금지 및 제한, 안전지대 등 통행금지 등 12가지를 제안하였다. 두 번째 제언은 긴급자동차의 불법행위에 대한 경찰의 단속강화를 제안한다. 교통질서를 문란케하는 견인차량, 긴급자동차 불법행위에 대한 단속을 강화해야 한다. 경찰당국은 견인차량이 우선통행을 빙자하여 난폭운전, 신호위반, 중앙선침범 등 법규위반행위와 긴급상황이 아님에도 경광등을 켜고 사이렌을 울리며 일반운전자들에게 위협감을 주는 일체의 불법행위를 철저하게 단속해야 한다. 구급차량이 교통체증구간에서 우선통행권을 이용 유상승객 영업행위를 하거나 공차로 사이렌을 울리면서 편법운행, 갓길 주행하는 등 긴급자동차의 무질서 운행행위가 일반시민들에게 교통안전에 대한 심각한 위해를 가할 우려가 있다. 세 번째 제언은 운전자에 대해서 철저한 교육이 이루어져야 한다. 도로교통법 제29조 제4항은 모든 차의 운전자는 교차로 또는 그 부근에서 긴급자동차가 접근한 때에는 교차로를 피하여 도로의 우측 가장자리에 일시 정지하여야 한다고 규정하고 있을 뿐만 아니라, 설령 위와 같은 법률규정 때문이 아니더라도 사이렌과 경광등이 작동되고 있는 119구급차, 소방차, 112순찰차 등을 발견한 경우에는 긴급자동차의 운행에 방해가 되지 않도록 신속히 진로를 양보하고 주의를 기울여 함은 운전자에게 요구되는 기본적인 의무이자 도덕적 요구라고 할 것임에도 불구하고, 우리나라에서는 운전자 및 법집행기관의 인식 및 의지 부족과 혼잡한 도로사정 등 여러 복합적 원인의 결합으로 인하여 실제 도로상에서 긴급자동차를 발견하고도 전혀 양보하거나 주의하지 않는 광경을 흔히 목격할 수 있다. 이를 준수하도록 운전자에 대한 교육이 강화되어야 한다.

Emergency vehicle operation management system needs improvement so that it can function as community security and public interests. As this privilege of emergency vehicles can be secured through giving ways by ordinary vehicles, only highly indispensable vehicles should be designated as emergency vehicles with strict inspections and examinations. Also it is important that an increasing number of quasi-emergency vehicles and the utilization of the vehicles beyond the limit of service use should be enforced rigorously.
